At least I would have saved £69 but I've learned a lesson way more valuable and that's not to ignore a debt just hoping it will go away after 6 years. Here's hoping as a gesture of good will they actually remove it. Although theoretically they could also put a satisfied default on my file as well. The irony is that I only found out because I wanted another contract with EE. They told me I'd never get another EE contract with the AP markers on my file until it was paid off, so that's why I thought it would be resolved. Interestingly Lowell put up a proper fight after their account dropped off the CRA but you're correct. It wasn't written off! They ended up agreeing in writing "to no longer enforce the debt"
    • I'm further confused, in your defence you stated: 1.  The Defendant is the recorded keeper of [motor vehicle] And not only that, this started out as you putting the wrong registration number in, you PAID for the parking, you just made an error putting the wrong reg in? ... de minimis? That was the crux of the case, what did the judge say about that?

    • Not prosecuting in the public interest seems to be bandied about on forums frequented by students. I don't think I've ever seen a prosecution not go ahead because of that. You would have to define why it isn't in the public interest to prosecute someone who isn't paying their way and is costing other travellers more. I can't think of a reason. HB

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sent my data protection letter for statements on the 14th September.

 

Suspect around £400 of charges in total.

 

Opened new account with A&L as precaution.

Ok, so not a peep from the bank of scotland about my statements!

 

They cashed the cheque for them weeks ago.

 

I wrote via recorded delivery again on the 6th October for confirmation of receipt of my request and still nothing.

 

I wrote to: Data Protection Manager, Halifax, Trinity Road, West Yorkshire, HX1 2BR.

 

I checked the forums for quite some time before choosing this address as the most successful one.

 

Anyone have a suitable phone number for me to call here?

Have sent off today a final 7 day SAR warning letter from the bank templates.

 

Has anyone else had a problem with the Bank of Scotland giving them their statements?

 

Seems strange that I should have a problem when I've written to the same people as everyone else..! And I don't even want that much from them!

hi, i called bos today regarding statements and insisted they send them via internal mail to my branch, she went 1 better and faxed all 144 pages to my branch there and then, tying up their fax machine for over an hour, hee hee:lol::lol::lol::lol::lol::lol:

Phoned customer relations to complain on 0845 603 7923 today.

I was told that they are dealing with my request and will telephone me with details of when the statements will be sent out. Apparently they are in the process of compiling my statements.

Not the smoothest of processes for me so far! Can't even get claiming until I have the flamin' statements!

So you'll see at the start of my thread that I suspected £400 in charges. Well it was actually £1500!

 

I've submitted a claim for this amount and I'm not too bothered calculating interest as I think I would struggle to apportion it solely to the bank charges.

 

Let's see what they say...!

After sending my LBA, I received a call from the bank on Wednesday 14th Ferbruary offering settlement of my claim in full!

 

Result!
