      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have just spoke to RBS Credit Card Operations as i sent them a nice letter asking them to reduce my rate otherwise i'll be off to more competetive provider etc etc. They said they cannot reduce the rate and will reply in writing but while i was on the phone i asked for the procedure in getting statements since i have held this account which is about 3 years. Now i wanted to pay by postal order as i don't have a chaque book but they have just charged it to my card which means i will pay interest! Also i've not known you being able to just ring up and request this info has anyone else done this? p.p.s is there a subforum for rbs credit cards? Am gonna ring Barclaycard now see if i can get the statements as easily from them! Any info appreciated :)

:) Thought i'd better set up a separate thread from my claim against the bank. I have the statments and am owed £142 in charges. Whats the best address to send too and do i edit the letter you send to your bank or is there a template for Credit Cards? :)

Ah there is one but its pretty much the same. So, Dumb question also do i use the simple excel spreadsheet and just edit it also as i am claiming for £20 a time late payment fees.

Why don't you use the 'advanced excel spreadsheet' and edit it as appropriate. :)

I'd have thought if the address was good enough to send a cheque to it would be good enough for MCOL! But have a look at the stickies at the top of the forum. There's one for the Litigation dept. in Princess St. and there's another one for Credit Management in Telford! You choose :)

i have been wanting to go for whats due to me from my RBS credit card for a while do i just use the template letters the same way as with the bank accs or is there seperate letters for credit cards, catalogue accounts etc.,

There is a credit card template in the templates library much the same as the bank letter. Just adjust as necessary. I just need to work out what i'm doin with the spreadsheet and i'll get round 2 underway £2000 they owe me Bar Stewards!

Im sure its the same as NatWest, if someone can confirm this to me then i would use their registered address to serve the claim on which is 135, Bishopsgate. London. EC2M 3UR this is where i served my credit card and other claims to and im sure its the same for RBS.

There's probably a word from A-Z that i could associate a swear word with regards RBS! But i will keep it clean hence the avatar speaks for itself! Will try and design a few more for all you fellow RBS fans and as im taking on Barclaycard and Blackhorse maybe a file with all there logo's redisigned for the 21st century!:)

The Statements were ordered by phone so didnt have an address forthat. The milton keynes address is just a payment centre. When i rang customer relations she tried to get me to email them via rbs.co.uk which i duly told her was not the way forward so im guessing the Edinburgh address listed in contact details or maybe the Telford address? Must be someone here who's took on RBS Card?

I will be going after RBS credit card shortly. My statements are sent from Southend on Sea, so I guess thats where I will be addressing my correspondence

1/9/06 RBS claim #1

8/11/06 - claim settled

17/11 claim #2 started - incl creditcard

30/11 - CC statements received

31/11 - Prelims issued - RBS paying up, only M/C to go)

Yes thats right thats what i did until the claim then i served the claim onto Bishopsgate as this is their registered address.

Have you sent the prelim letter yet?

I don't have it and to be honest i don't think it would be the correct place any how. Have a look in the contact details thread i am going to use either the Telford address or The Customer Relations Edinburgh address.
