Hi, I live in London but will be claiming against Sainsbury's Bank visa card, which belongs to Bank of Scotland, does anyone know :

 

1. Which do I file my claim against, Sainsbury's Bank Plc or Bank of Scotland? and

2. As the address I have had correspodence with is in Scotland, can I put their scottish address on my court forms and go through my local county court or do I have to file a claim in the Scottish courts?

Ah well I shall answer this myself, after doing a lot of reading I have discovered their registered office is in London - 33 Holborn, London EC1N 2HT if anyone else needs it :oops:

hi bong i am a day behind you in going the court route i was wondering what your thoughts are on the particulars of claim 5(b)

b) a declaration from this honourable court that the term of the contract leading to the application of the charges is unenforceable;

what i am unsure about is the feeling lucky part don't know what it means

Hi countrybake, personally I've decided not to include it in my claim because I thought from the 'feeling lucky' comment there may be a chance the court wouldn't like it and it might jeopardise my claim, also I thought the wording was a bit vague ie. term of the contract, surely the court would need to pick apart the terms and conditions and it might start getting complicated. Probably me getting unnecessarily nervous though. I wonder if anyone else has been successful in getting it through? Also, I'm assuming that the bank will wait until the last hurdle before backing down and they're unlikely to give you such a declaration themselves. What do you think?
