Approval was given for a monster extension on next door house in April 2009, despite many objections. Building not yet started. Recently discovered that planning case officer was disciplined and demoted last year for building his own house extension without planning permission (!). Although council have now agreed to "look" at the plans again, planning permission will almost certainly not be withdrawn.

 

Do we have a legal case against the council for incompetence or is this too tenuous ?

You may have grounds for a complaint to the Local Government Ombudsman, but regardless of his findings, as you say, it's unlikely that the decision would be reversed. Even if the council "look" at the application again, all the committee has to do is confirm the original decision, ie procedure wasn't followed but if it had been consent would have been given anyway.

 

Only the applicant can appeal a decision - objectors can't.
