    • There's a thread somewhere about someone sending the baillifs against Wizzair that is quite hilarious. I would love to see someone do the same to Ryanair. Question is, should you be the one to take that role. You are entitled to the £220, if your flight was from the UK. If it was TO the UK I suppose it is more of a grey area... though the airlines I know have been using £220 as standard. Not that surprising for Ryanair, the worst cheapskates in the universe, to go for the lower amount, and if you forward this to the CEO he will probably have a jolly good laugh and give his accountants a verbal bonus. After all he's the one who said and I paraphrase "F*** our customers, they'll fly with us again anyway". While we would all love to see Ryanair get wooped in court again, I have to join my fellow posters in thinking it's not worth the hassle for (hypothetically) £7 and not sure it will expedite the payment either. It's already an achievement that you got them to accept to pay.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I booked a flight with Thomson Fly at the weekend for someone and since then the person have changed their mind due to other commitments they can't get out of. I have phoned up Thomson this morning a full 25 days prior to the flight to cancel and they tell me I won't be refunded. Now I expected a small charge but the complete fare is in my opinion totaly out of order considering the time limit. I have looked at the terms and conditions and could'nt find very much regarding Cancellations.

Any help in this matter would be gratefully received

Itmight be worth sending them a letter saying that you regard this as a punitive measure for a breach of contract, and as such would not be enforced in a court.

The measure of damages is always the actual losses suffered by the company.

Ideally you need to know whether they sold the seat on to someone else. If they did then you would be entitled to nearly a full refund whether they like it or not. Very difficult to find this information out though.

They have a duty to mitigate their loss. Do you have a seat number allocation?

The problem is that alot of the budget airlines don't allocate seat numbers (easy jet don't even allocate a seat number at check in, its just a free for all when you get on the plane!!) they usually have in their terms and conditions that the tickets are non refundable, however most will allow you to change the date and or name on your ticket for an admin fee. (I've just checked ThomsonFlys T&C and they do state "All bookings are non-refundable.")

Even scheduled air (British Airways, Virgin etc) have rules on their tickets, the cheaper the ticket the more restrictive the rules. For example you might buy a flight to New York with British Airways for £200 plus taxes, however the ticket will probably have 100% cancellation charges. First Class and Business Class fares are the highest and are therefore less restrictive.

Does your friend have travel insurance? If they can't travel for a reason covered by their insurance then they might be able to claim back any money lost.

T&Cs are not relevant here - just like the banks

OP said other person changed their mind. Travel insurance won't cover that.

On cheap flights, the excess alone would probably be close to the cost of the flight.

Only way for that is if the plane was actually fully booked. If there's 1 seat left, then the airline can say they could have sold the seat back (even with 25 days left between cancellation and flight).

There's also the fact that there could have been some manual intervention in booking/cancelling the flight (they can be booked by phone, means there's actually someone manning the system, manually inputting details), which will mitigate the amount to be refunded. Again, on a cheap flight, the sums involved may well negate the cost of the flight itself.

I used to work for a well known airline in Luton. We always oversold our flights! If noone checks in for your spare seat, they may well check someone else in for it. I would not guarentee on having your spare seat!

Will they not let you transfer the seat to another flight, and you can enjoy the use of it another time?

If your spare seat is taken by someone else then don't worry, we can help you get your money back.

Now that you are travelling on the foight and can see what is happenng yu are in a good postiion.

If your spare seat is taken, then during the flight walk up and down the aircraft and note how many seats and which numbers are unused. Try do this very discreetly. If the cabin crew ask you what you are doing, just say that you are doing your own private survey.

try and make friends withthe person in your spare seat and get at least a name anda few details such as occupation etc - the kind of things that come up in casueal conversation.

The when you get back, come back here.

If the seat is empty then forget it.
