    • I'm afraid that if the value of the item was under declared then that is probably the best that you can hope for. Also, because the item was incorrectly addressed – even by a single letter, if that because the issue relating to the delivery then that has probably compounded the problem. There is probably very little that can be done. If you are lucky you will get the item back and then you can start again and declare it properly. Undervaluing parcels which are sent by any means is always going to cause a problem if the item is lost or damaged. It may mean that the cost of delivery is slightly less – but at the end of the day the risk becomes yours. When you enter into any kind of contract, effectively you declare it a level of risk to your contracting partner – and they decide to enter into the contract with you based on that level of risk. You have declared a level of risk and £50 – and that's the deal.   Additionally, undervaluing an item which is an internationally has the effect also of evading customs and any VAT system which is in force in that country – and that makes the whole thing a little bit more serious
    • Perfect. Nice and brief and to the point. You don't bother to start telling your life story. Just the way it should be. Send it off. You have probably done enough reading to understand that it won't make any difference don't start drafting your particulars of claim. Open an account with the MoneyClaim County Court system and start preparing. Post your particulars of claim here before you click it off. You may have noticed that at some point you will be asked if you want to go to mediation on this. We used to advise it but now we recommend that you decline mediation and go to trial. Your chances of success are much better than 95%. Going to trial will incur an additional hearing fee but of course you will get that back. However if you go to mediation, they will simply try to penny pinch and to get you to compromise and also they will sign you up to a confidentiality agreement and probably threaten you if you breach it. Not only that, if the mediation fails because you stand your ground, it will add additional delay while they then give you a date to go to trial. The best thing to do is to decline mediation – prepare for court hearing. Pay the extra fee. The chances are that rather than get a judgement against them they will then offer you a full settlement rather than go to court. If they do offer you full settlement then you will be obliged to accept it – but that's what you want. If they don't offer you full settlement then you will go to trial and there will be a judgement against them. Just so that you understand, our first interest is that you get your money back – but a close second is that it does go to trial and there is a judgement which we will then be able to use to help other people. Anyway as you should realise, we will help you all the way.
    • I sent a parcel to Singapore but i spelt the address incorrecltly by 1 letter so the parcel couldnt be delivered and was returned back to the Uk but checking the tracking today the parcel had returned to the UK but is somehow on its way back to Singapore as the tracking says "Item leaving the UK"    Ive spoken ( tweeted) Royal Mail help who confirm that the parcel seems to be going back to Singapore and that if its not " Delivered" by the 29th of April theyll deem it as lost and will accept a claim but i cant remeber when booking what the compensation amount was but i dont think it covers the amount of the item.  As it was my fault that it wasnt delivered in the first place can i trey and claim the full amount back ? i think if i remember correctly it was £50 compensation but the item was £170 So the timeline is thus ...   22nd Of March .    Booked via P2G & dropped off a Post Office.  25th March arrives in Singapore and goes through customs ect ect 26th   Incorrect address and item is flagged as "return to sender" 28th Item leaves Overseas intenational processing centre 15th of April , Item is leaving the Uk (Again)   ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok so hubby and I are both pursuing claims against several credit cards, but I knew the biggy was always our current account. I was going to leave them till last but I had been corresponding over some recent charges with them, some being refunded some not. getting sick of their messing around I decided to get all the statements out and work out what they have charged us. I was shocked, even with some refunds over the years (when we have queried the application of charges for various reasons eg, we had phoned up and arranged an od, paid cash in a different branch,were assured a cheque was going to clear into the account by a certain date etc) they have charged us around £4000!

I therefore wrote a prelim with this figure and went away for a couple of weeks to see realitives in scotland. Came back to a very snotty "bog off" letter which I expected. However we also got a phonecall from a very nasty women at rbos. Unfortunately whilst we were away we had gone overdrawn. This was agravated by the charges (of course!) and we were £286 od. Now given that we have around £2k and up going thro the acc each month you wouldn't have thought this was a big deal.

I explained the amount would clear on my payday at the end of the month ie next week, we wouldn't attempt to put anything else through the account and no further dds are due till sept. She stated as one of the charges was for "card misuse" on a cheque (a miscalculation on hols not deliberate) they were demanding the return of our switch cards and cheque books. Luckily we already have a parachute account for the future, but this was still a shock.

All round she was very nasty and told me it was a criminal offense to write cheques "knowing the cash isn't in the account". I asked if any of their action was due to my request re the charges. She seemed unfazed by my question and knew "all about THESE requests by customers. She just stated repeatedly it was a side issue and made a sarky comment about me being "the one person in the uk who takes this to the high court and wins" when I pointed out it would be in county court and was a civil matter she snapped back "i understand the law just make sure the cards and books are ret staright away goodbye!"

Stupid cow. Upset me a little bit at first but then I just had to laugh at her. Just getting ready to do an lba.

This sounds unduly harsh.

iGroup (GE Money) - AoS Filed late, defence late, amended defence also late despite extra time requested and granted.

Vanquis - Claim issued, no AoS or Defence received

They did it to me, for being overdrawn. I think it is when you mention about reclaiming charges etc....

card misuse from what they said. Like alot on here we have had problems on and off but we are mostly ok now with our account, and we don't have a overdraft at all now. I suppose they can use any excuse they like as long as its in the t &c.

I don't dispute it, but I wonder on what grounds they have asked for the return of your cards and chequebook. Have they quoted a reason?

 

You don't have an overdraft, yet they want your cards back. Have they mentioned closing your account?

 

Perhaps this is a new tactic and I have this to come.

I had a premier account with them, this had a £1000 overdraft limit, due to me being off work for over a year the overdraft hovered around the £200 mark. My account got moved to Credit Management services without me knowing. I got a very snotty phone call telling me that I had been misusing my account and they were closing it. I tried explaining that I had a premier account and that I had a £1000 overdraft so was not breaking any agreement, this did not matter, they closed my account. I am now having great problems in getting even a basic account. Oh yeah claiming £735 on old business account and £4025 on my "closed" account. Just my rant at the RBoS.

I got the letter saying return my card and chequebook, called the telford office and said my balance would clear within a few days.. musta been my sexy accent because the operater (who I think was an 18 year old boy) said, oh thats ok just bin that letter then... Weird..

We have had confirmation from RBOS that our cards and chequebooks are to be returned by the end of the month, as they stated over the phone. Our account is back in the black but they still say they want the cards/books back to "help you avoid further charges". They will issue us with cash cards only and we can still have dds etc pon the account. They have not mentioned account closure (as yet lol), but we have another account already up and running. Because of the extra charges from when we were on holiday I did a revised prelim letter, no reply as yet and 14days expired yesterday. Gonna wait till after the bhol and do an lba. From the other threads on here I expect to go to court action with this, so maybe they will close the account then who knows lol.

I have been in correspondance with RBOS over some recent charges and got some refunded, but decided enough was enough I want to reclaim all the charges made. Went through 6 years of statements and found a total of £5385 over the 6 years up to August 06, also over the same 6 years because we have sometimes queried the application of charges(for example after paying in cash and being assured no charges would be applied and then they were etc.) there were some refunds these totalled £1052. This left £4333. I sent a list of all the charges and refunds month by month, type by type to RBOS with a prelim letter for the £4333. I was due to do an LBA now,but got a letter today offering £2462. Very tempted as with 2 small kids and a tight budget could do with the cash, but want to get the lot if I can lol. Just wondering if anyone who has claimed against RBOS could give me an idea of what time scale it took for them to get a full refund 2 months?/3 or more?

If i write back accepting the £2462 as a partial payment do they do like CAPONE and actually pay it to you or do they withdraw their offer. If you see my other RBOS thread you can see we have already had our chequebooks and cheque cards taken off us (just after my prelim landed what a shock lol) so suspect will have to wait a fair while to get any dosh from them. I sent off my prelim letter in May and received cheque for full amount on Saturday, so I'd say approx 3 months.

 

They usually withdraw the interim offer, but for the sake of an extra £2000 its worth waiting the extra 8 weeks.

In shock here, was expecting long battle against RBOS. Sent off my LBA and was expecting to issue money claim this week. Got a letter on Sat offering full settlement!!!!!!!!!!!!!!!!!!!!!!

All usual guff about being a goodwill gesture etc.

Will await the actual payment before I can believe it. Is this the new tactic, have they decided its costing too much to pay the solicitors when they are just going to cough up later anyway?

Ours wasn't exactly a small claim (just under £5k). Gonna be a good christmas here. Thankyou so much to the moderators and everyone else on here, the info and experiences you have all posted gave me the guts to start this. Will send another donation when Tommy coughs up :)
