      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All

 

I am just starting action against RBS. I am still awaiting my statements as it woul seem my branch tell me that they were sent out to my old address (security risk?! compo?!) They have had over 40 days and i fired off another recorded delivery letter today to ask where the hell they are!? Any advice recieved gratefully. Super website, i have purchased the lawpack and look forward to making a rather large withdrawal from The Royal Bank of Scotland in due course!

Did you update your details at the bank for your new address?? Also read the FAQ's and step by step and follow the info on there.

 

Also start a thread in the RBOS forum and take a few days reading in there and you will see how others have delt with this.

Yes i changed my address in writing as you have too. It's in between them changing there records that the statements apparantly have been sent too my old address. I will say hello in the RBS forum and check out all the info as you suggest. :)

Hi Fellow RBS campaigners! I am just starting action i have been waiting over 40 days for my statements and have today sent letter number two! They apparantly sent the statements to my old address as i moved recently BUT changed my address in writing with them. Could i start further proceedings lol?!

 

Will keep you all posted, and i look forward to making a large withdrawal from RBS in the near future. Hopefully get a fistful of dollars back :) Keep it real!

You need to make sure you stick to the same thread if you have already posted on this matter. They kind of have done the same to me, i would write into them advising that they have actually broken the law and the Data Protection act by supplying your personal account details to the wrong address, i would definatly tell them so they are aware that you are slightly annoyed.

it depends how you want to view this 'honest mistake'. You could take the line advocated above or ask them to provide another set of statements pronto and free of charge as a good will gesture.... Not sure if the DPA violation will work. Do you have any mates/relatives close to your old address that could check up on your mail at that address?? If so, try it and see if they did send them.

 

Personally, I would phone your Branch or visit in person and get another set sent to your correct address. Unless of course you have allof the relevant statements and you can press on anyway. If that's the case then sort out your spreadsheet (and I would ask for the statements anyway just to inconvenience them anyway!!) and move on to the Preliminary Approach letter. Softly, softly catchee monkee.....

 

Anyway, you can always press to test on the DPA violation later if you wish. Prioritise what you want, ie your money back!

Well i finally got the statements through to large brown envelopes slightly torn as they were so big the postman must have had to use brute force to get hem through the letter box! Now whats the plan? I thought go through with a highlighter pen to mark all the charges then add altogether plus interest. Anyone got any advice on the quickest and simplest way?! :-)

Yup, you're damn right....

 

make a copy of the spreadsheet in the Templates library and plug in all of your charges and dates, the spreadsheet will total it up and work out your 8% interest (or more complicated versions as you wish). Just remembet to transcribe exactly what the statement says into the spreadsheet (ie Card Misuse etc). Include any charges but not those for 'services' (Royalties etc). Then you can start your next letter asking nicely for your money back!!

Just wondered, while i was bored at work today i created a manipulated RBS logo with the S changed to a $ looks good! Can i use it as my signature?:) pleease

You can't put images in your signature, but you could use it as your avatar if it is 80 x 80.

Well i got my statements they go back to May 2001, after speaking to the branch they say thats when the account was opened but i'm sure i have had it longer. Anyway just a couple of things there are a couple of referall charges what are these? Also there is a monthly charge for interest, do i hit them for this too?

Clint,

 

referral charges are for when they have cashed cheques for you over your O/D limit and the like, so yes you can claim it. I haven't claimed for the interest charge, as the spreadsheet works out 8% anyway, but I believe one of the spreadsheets is set up to do it.

Yeah i know about the spreadsheet but my statements actually tell me how much interest they have taken per month so i think i might claim that on top of the charges. I have calculated it and the Grand Total is............£2015.43 from May 2001 to Aug 17 2006 i think i may have a couple more on later statements. Just another quicky...Regards my RBS Credit Card of which i'm about to start sifting through cash handling fee £4.00 charge

Is that for taking cash out of an ATM, if it is then thats a charge for a service and you can't claim it back...

Anyone know the best address to use for reclaiming Credit Card late payment fees is it the Edinburgh address or the Lending Operations Telford address is contact details?

Do i just use the same letter off here that i used to send to my bank and edit the bit about direct debits and stuff as obviously that does'nt apply or is there anothe one specific to credit cards? :confused:
