A quick requewst for clarification on Council Tax liability please

 

Self 61 in full time employment

 

Partner 50's just started full time (non residential) Degree Course

ie lives in family home

 

Sibling 24 on perm Incap Benefit ( or whatever its called)

 

Could someone just confirm who is liable for assessement for CT please?

What is the status of each person? - Owner, tenant, resident (neither tenant or owner)

 

Students are exempt and disabled people can sometimes qualify for a reduction but this seems to be based on the need for extra space because of the disability rather than just on the disability.

If you or your partner are the resident owner or tenant then you will both be jointly liable.

 

s6 of the Local Government Finance Act 1992 provides for the person who is liable with s9 (as amended) providing for a spouse/partner to be jointly liable.

 

However - if the partner is a full time student for council tax purposes they cannot be held jointly liable and you would be solely liable.

Thank you for your observations

It is a rented property

Self and spouse are listed as joint tenants

There is no specific requirement for extra space/facilities for "disabled" son

 

So if I understand correctly, I can claim exemption for son and wife ( as full time student) leaving myself as the "liable person"? I wonder if this goes towards the route of single occupant?

 

All advice gratefully received

 

and its rather annoying that out of the Student loan package, the amount paid directly to the Uni is classed as income - which of course, she does not receive directly !

Your wife could be disregarded (assuming she meets the council tax criteria for a student) but there is no council tax disregard for your son just on the basis of being in receipt of incapacity benefit.

 

A disabled person is disregarded for council tax purposes only if he is 'severely mentally impaired' and a medical professional certifies this.

 

Unless your son can be disregarded then there are still 2 occupants who are counted for council tax purposes and as such a single person discount does not apply.
