      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Whats happening with those of you who havent had your statements are you going straight to LBA with a guessed amount? (how can this work with the 8% interest as you wouldnt have a breakdown of charges) Im at the same stage over 40 days. can we stick together on this one. skeggsy x

thanks for reply judge - i thought that too but after reading what Bank Fodder had to say about claiming pre 6 years we decided to go for it as we have nothing to loose so lets see :)

can i ask how you have managed to put in a claim for post 6 years if you dont have the statements? or did you?

skeggs - daughter just got account number for pre six year account from nationwide with just a phone call - unfortunately she has been in hospital so has not started the statement process but will do very soon, will keep posting on here as and when - good luck with yours.

quite excited by this potentially a break through, ok will have to wait and see the proof is in the pudding but rang data protection dept at nationwide today and complained that Im past the 40 day period, said i had already reported this to Financial Ombudsman and didnt really want to have to take it to next stage so they had ten days to get my information to me. The guy I spoke to was remarkably helpfull and told me what year I opened my accounts all 93 and 91... He then told me he would be able to send me the statements from 14 years back!!!! great ... he also told me I wouldnt be able to claim post 6 years anyway!!! er ok lets have the statements then and we will see. will keep you posted. skeggsy:p

If they dont send them in time could you just not say right im claiming £xxx amount its up to them then to prove its less and as they took over the said time (40 Days) there in the wrong ?? just a thought

check out my last post re this got told today could send me statements from 91 and 93!

Getting Angry now, still waiting for stuff from SAR from Nationwide credit card since Feburary 21st, Sent a LBA on 5th May, and they replied on saturday telling me I hadnt paid my £10 fee, this was cashed by them on March 8th, Have tried to ring them all day today and cant get through, its constantly engaged.

 

Not heard anything back re claim for my flex account, letter sent 5th May.

Hi Im just about to do my request for my statements from Nationwide but I am not sure which is the right address to send the request to. There is a general address and then someone else has posted a direct address for the Data protection team. Also is it the same address for Nationwide Credit Cards. Can anyone help ??? Thanks

My first two claims I sent everything to the Head Office address in Swindon, have noticed that Data Protection stuff for 6 year period comes from different address data protection flex statements. UC Hawksworth nW5001 Swindon sn38 1nw (excuse lower case had to unplug lap top to get address) I have sent my most recent request (for about the 5th or 6th time) to this department direct recorded delivery of course but Im just getting no where mine is around 50 to 60 days now forget the 40 days. I have as mentioned reported to financial ombudsman and also information commissioner by e mail but not had a response from information commissioner so going to ring him tomorrow. Know they are being devious and today they have decided to pull the plug on my overdraft on that account. very disapointed with them.

Dont hang off for fear of loosing your overdraft. you can set up another account with Halifax who will match your overdraft and give you the facility straight away, you can do it online or on phone.Nationwide will pay you out then you can close the account if you want to... set up the account then if they do ask for the overdraft back and they wont unless you go over it or bouce something or if you are not puting enough money into the account then you can pay it off and switch to the Halifax account or whatever one you choose. Im hanging back on wasted costs claim because I still not know exactly where I stand on it dont be afraid you will win get it in.

Hi all

 

Hope this helps, I've had a massive chase around this afternoon trying to get to bottom of my SAR, but if other people can benefit from the knowledge I've gained, cool.

 

I sent my SAR on 24th April, recorded del - was received 25th - to the DP team. Heard nothing, so rang today (gave myself a cut off past 25 days & would call if not received info). I rang the Account Services team (details at top of post), who passed me onto Complaints, then in turn gave me number of (01604) 854828 & Name of KATH BARFORD.

 

Rang that number, spoke to SUE TAYLOR who told me that due to weight of demand for SAR, they have set up a new team (FLEXACCOUNT STATEMENT REQUESTS) with tel no (01793) 583061 & 583062, but both numbers will be very busy. So, I rang second, got straight through to SADIE, who (like everyone else I dealt with this afternoon) was very pleasant, friendly, professional & helpful. Basically, she explained that have been deluged with requests and constantly keep revising processes, teams, departments & staff to cope. As requests are not logged anymore on the database, they are wading through the in tray & dealing with them in that order, but because of my delays she will request details of my charges instantly, computer process them overnight & as it's after 3pm they should be ready by 1300/1400 tomorrow. She said it will be an abstract of both account's charges, one single A4 page each (no need for statements unless for cross-checking at this stage), and will telephone me when they are about to be sent. I asked if she could give me the 'bottom line' verbally from these abstracts and she agreed. RESULT !

 

So my strategy is this, see what the figures come out to be, then request refund as normal. In meantime re-request statements to cross-check against, and while I await their response to my refund request also determine if the abstract amount matches the statements.

 

So, to be honest, I'm quite surprised. Bit deflated they not been in touch already, but I expected would take a while due to weight of numbers. However, it's nice that for now at least, they seem to be sugar coating their interaction with customers, I expected a more terse and adversorial approach.

 

Hope this info helps others waiting to find out what their charges are, at least as considered by the bank or BS.

Nationwide have real problems understand two words 'customer' and 'care'

 

My bonds matured so I loooked around for e decent investment. Saw it at Santander. But almost two weels after maturity Nationwide still haven't paid me my principle and interest. They have this 'leagalised [problem]' that holds on to customers' money until really pressed.

 

Wow, imagine the inteerst they are making on our money.

 

Nice work if you can get it - and it seems Nationwide can!

Forgot to add - I'm severely disabled. I need the money - do Nationwide care? Big isn't always beautiful and in the case of Nationwide its positively ugly. Nationwide rides roughshot over customer cpmplaints. Whatever you do, avoid them like the plague
