update on this one. checked the credit file, debt is on there assigned to 1st credit as defaulted 12/9.

 

to be honest ive not paid anything on this particular debt although i am claiming ppi via everyday loans which are the OC. Mckenzie Hall are now advising legal action to be taken shortly!

Is this one of MHs ''we may'', we might'', we could'' threats of court action or have they actually say they WILL take action??

I have an old Everyday loans debt from 2007. It was passed to 1st Credit who registered it as a default on my credit file in 2009.

 

The debt is at 2k, i ceased payments this year to 1st credit due to unemployment. i now have McKenzie Hall chasing with the usual spiel of taking me to court etc...

 

1st Credit are now refusing to negotiate with me. Do i just deal with OC from now on as i am claiming PPI back from them directly?

Your PPI claim should be lodged with the oiginal creditor and not a Collection Agent. In addition, if you are in Scotland the debt MAY be Statute Barred in any case (Scotland after 5 Years) This of course is dependant on when you last made payment or provided written acknowledgement and not the default date. If your are in any other part of the mainland the SB period is 6 years. This being the case go for PPI and charges.

Apologied for rebumping this one. Having been unwell in the last couple of years, I have not done anything with this debt

 

I have continued to pay £1 a month to 1st credit leaving the debt at £1989 (in their letters) bit getting offers to settle for £700.

 

Having reread the previous advice.

 

I have now cancelled the payment and logged a complaint for PPI with Everyday.

 

Is there anything else I need to do. SAR for any other charges?

 

Apologies for being unclear on this, would any charges vastly clear the debt?

well there wont be any extra charges if it had already been sold on to a DCA and you sent the 1st sar.
