Bad Plumber what are my rights ?

We had an Insurance claim water leak that went into ceiling downstairs

 

It involved taking out bath and toilet upstairs

 

Long story but basically plumbing has put in shower unit incorrectly

 

The manufacturing will send evidence it has not been put in incorrectly

 

However Plumber is looking for nearly full payment to carry on (he has been paid about 30% so far) and wants to charge extra if glass door needs to be cut or he has to re-do it.

 

I assume we can offer him to make good his mistake (without additional payment)

 

He has been a nightmare re availability turns up goes after 2hrs etc etc

 

Insurance has paid us 70%

 

I assume if we get someone else who may have to wrip the whole thing out if it cost more then original quote we have to pay it and/or sue plumber for difference ?

 

This is an expensive shower unit with expensive tiling etc

 

To complicate things he has done extra work in the bathroom unrelated to the claim which we were happy to pay for but again the standard isn’t good and its no way finished.

 

I get the impression if we give him any more money he just will take it and wont turn up. He is so busy with boiler work

 

What rights do we have ?

 

Should we tell the Insurance company ?

He's not based in York and called Richard is he ? Glasses ? citroen van ? Don't go near him.

 

If you haven't paid for the work and are not happy, don't pay. You will need to get someone else in, but they may not want to take over someones elses inferior work. Tough one this one.

Remember the Supply of Goods and Services Act 1982. This states in Section 13 that in a contract for the supply of a service where the supplier is acting in the course of a business, there is an implied term that the supplier will carry out the service with reasonable care and skill. This may prove useful.
