Dec 2006 SARS request :p

 

5th Feb 2007 initial request inc list of charges totalling £1706.50 without 8% interest :o

 

15th Feb 2007"bog off " letter received.:(

 

19th Feb 2007 LBA sent with further copy of charges:|

 

4th April £750 goodwill gesture paid into bank

 

11th Aug 2007-another £704 charges since and lloyds served me with enforcement notoice

Its been mentioned on this forum a few times before..

It could be a Debt Collection service or something..

Well years ago my husband got behind with with his credit card payments.

The debt was taken over by a debt collection agency.

We set up a DD for 44.00 a month to pay off the 750.00 outstanding.

This carried on for years .I dont know how many, but talking 5 years plus.

 

So i figured we had paid back over 3,000.00 of the 750.00 and cancelled the direct debit.

We tried on several occassions to obtain any sort of statement but were declined every time.

 

They slapped a default and said we still owed 350.00.

We tried again to explain that we weren`t disputing anything

-all we wanted was something in writing/payment record/statements ect.

Again they completely refused.

 

Now i am in the frame of mind to check all this out

all i can find on my statement with my current account is a Debit of 30.14 a month to 1st credit ltd.T

 

hey refused to send any form of paperwork what so ever,

and because i was so upset about the default at the time i just agreed to make the payments.

 

I think we must have paid 3-4,000 pounds now and original debt was with Barclaycard for 750 !

Depends how many years you want to go back...?

You could have a go, send a few more letters and seek advice in the bank charges forum....they have more expertise over there.

I'm having 'fun' with first credit at the moment - they really are a shower of the unmentionable!

 

First thing is to send off a Data Protection Act request - you'll find all the details on this site (look in the Bank and Debt Collection aganecy threads). That will give you statements, details held on file, etc. They should also (I believe) send you various information required under the Consumer Credit Act too - again look in the Debt Collection Agency threads. Having this info to hand will give you a chance to organise your approach.

 

If they fail to give the required info that you have asked for in the correct way then they are the ones that are 'in the wrong' and your position is strengthened!

My husband and I have a power of attorney for our son who is abroad. We are battling with First Credit, who insist he owes money but have taken over a year to fail to provide proof. They are turning nasty.

 

This don't scare me none as I used to practise law and they are going about it all wrong, including breaching their own code of conduct. Please let me have whatever ammunition you can offer to blow this ******* out of the water.

The first I heard of them was a letter saying that a charging order would be put on my house due to an alleged debt from a joint owner. There was only 3 weeks. I contacted them by letter, they ignored it. I emailed them, they ignored it. I wrote to the court, they ignored it. The charging order went through. I have never been in debt and now the equity in my property is being grabbed by a bunch of thieves. They did not want to even talk to me to sort it out, they just wanted to snatch the property.

I have complained to the law society about this company and their legal wing - LCS, which make the whole legal profession look unscrupuilous.

Ive got an ongoing complaint about them going on through the fos, due to the nature of the threats they made against me (including inferring I was lying about not owning the house I lived in, and breaching several laws including the Disability Discrimination Act, and also saying they were going to do things which are highly illegal - fraud, theft etc)

It turns out they didnt even have an enforcable CCA - actually, scrub that, they dont have a CCA full stop.... best thing to do is find out if they have the right to collect the debt, chances are they probably wont as in my case. Now they are going to be in a load of doo-doo from my end... just dont give in!

1st Credit (Lloyds TSB) admitted no CCA, reply from OFT 130608, reply from FOS 040608, adjudication stage rejected but still no contact....

300608 -Long running battle,threatening court, CCA letter NO 2 and harrassment letter sent - passed back to Littlewoods early July.

070808 - Passed to Debt Managers, Acct in dispute/BOG OFF letter sent 080808...

140808 - Letter from Debt Managers passing debt back to Littlewoods - RESULT! :D

Well it seems the court thought they had a right. I am not the debtor so 1st credit's response is that they refuse to talk to me. I had an intersting phone call on their premium rate number with a spokeswoman for their company. 10 minutes of serious language problems, it seems a British accent is hard to understand, then they cut me off (I have a recording of this conversation).

So I now part own a house with a credit company even though they agree I have never been in debt with them.

Had a text from 1st Credit today asking me to 'phone an 0870 number. I thought it was a [problem], so I spoke to Trading Standards who told me it was a company in Reigate and provided me with their landline number of 01737 228555.

 

The lady on reception and the supervisor, who was the last member of 1st Credit's staff I spoke to were fine, sadly the other three were aggressive and ill mannered and, I was not the debtor!

They make their own rules and the courts bend to their will. I wrote to the court but the letter was simply ignored. Enclosed is a quote from my emails with 1st direct which shows the type of people they are.

I also have a recording of a telephone conversation with 1st direct in which they admit they have no interest in fixing the debts only of siezing property. They are a truly evil organisation.

I recieved a letter from 1st credit saying I owe Money shop £150 for a cheque which was not honoured by my bank. i have asked them for details such as the account number and date of the cheque. The so called female telephonist was very snotty and abrupt on the phone. She insisted if it was prove that i we the debt they want paying straight waay. i told her if it was proved that it was my debt I would make an offer of payment, but they have got to prove the debt first.

I am waiting, they threatened me with a bailiff too.

Can't wait to see the outcome.

got a letter a week ago telling my husband that he owed £2500!!!!!

this came from a bolt out of the blue. When he rang he was told that it showed on file that it was clear!!!

after asking for this in writing and feeling very bemused we awaited our letter

It didn't come but another letter from their(debt team) did. it said to get in contact to arrange payments.

He rang back and got further information about where it had come from. It came from an old credit card that we thought had been paid off in full.

He rang the credit card company who told him they had sold the debt on to 1st credit and they coudn't help anymore with questions. The one thing he did find out was the amount that we had paid (final payment as far as we were concerned) was made in 2002 and the acount was stopped and the card was cancelled at the same time.

We have heard nothing from anyone in 7 years until this letter from 1st credit, a weeks ago.

we got back onto 1st credit and they said the additional so called debt of 2500 is now showing as being owed.

It was ended by my husband telling them he was getting legal advice.

help we need some!!! can't believe we have a had a so called debt for so long and never been approached for it.Further more we had already made a payment to the credit card company 7 years ago for nearly a thousand pounds and thought it was paid in full.

anyone got some good suggestions???

“Under the Limitation Act 1980, which applies to England and Wales, a debt is considered to be statute barred when no payments have been made against it or where it has not been acknowledged for six years. A statute barred debt cannot be legally recovered. Whilst the OFT accepts that the debt still exists, the OFT considers that it can be unfair to pursue the debt in the circumstances set out in our Debt Collection Guidance

Quote from the OFT MACKENZIE HALL PDF document:

“REQUIREMENTS IMPOSED BY THE OFT REQUIREMENTS RELATING TO:

MACKENZIE HALL LIMITED

A debt is considered as in dispute where:

A request under section 77 or 78 of the Consumer Credit Act 1974 has not been complied with, and this prevents the agreement being enforced without the permission of the court”

I suggest that the above reference to ss.77 and 78 of the CCA 1974 is a very strong endorsement of the rights of consumers to be provided with true copies of Regulated agreements.

Re Ist Credit

These are a debt agency who are nothing but trouble!

I have a credit card debt which I am paying back to them weekly via postal order.They keep saying that I have missed payments even though I have got every single post office receipt for the payments and in some cases I have managed to track and trace some of them and kept records to prove it.

What can I do to get them off my back another 5 weeks and it will be paid off....according to my records

HELP!!!!

I moved over to north America almost 6 years ago in 2004. I had a personal loan through Northern Rock in the UK just before I left. I made no payments since I moved to north America until I started to recieve calls from First Credit, with who the account was passed onto. After particular calls threatening me with this and that regarding this debt, I didn't miss a payment to them yet. Now, I find out First Credit were featured on BBC's panorama, and I read forums like this one. The only thing is, do I still have to pay my debt or not, I'm not sure???

 

If anyone has any information for me on this at all, however little, I would gladly appreciate it.
