I rented my house, the tenants burnt the house it was completely burnt down i was exempt from paying the council tax but now i have received a bill for this year and received summons for it. would it be possible for me to prove to the judge that i am not liable. may i have some advise on that.

More information would be good.

 

When did the house burn down? Did you get exemption for this year but now have received a bill? Have you got written confirmation of the exemption? Have you spoken to the Council? If so, what did they say?

 

There is an exemption for properties that need/are having major works to make them habitable but this can only be in place for 12 months.

Your confusing liability with the payment of any council tax that is due - your still liable regardless as the owner whether there is a charge due or not.

 

Aviva is correct reagrding a Class A exemption but dependent on the amount of damage you can apply to the VOA to have the property removed from the council tax lists.

 

The magistrate cannot rule regarding exemptions as that is a matter for a valuation tribunal.
