      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

locutus i think this thread is worthy of a sticky i say this because many disabled would find this useful as in my case a stroke survivor who has memory problems and finds it (or did) a real pain to remember where stuff is

 

It took me 30 mins yesterday to locate disk defag so you can see just how useful this button on the desktop will be

That's up to "the powers that be" I guess. I'm glad it's worthy of such praise from you. As you know it's a collection of over 200 tools and settings that are normally accessible from "Control Panel". It'll still take some wading through to find what you want, I'm glad I could help :)

ok its not a miracle as we thought, post from a windows techie says :sad:

 

Windows XP has this same feature (as does every Windows OS) it is called the control panel :rolleyes:

 

dam I searched about it then the penny dropped, I have the ICON on desktop already I put it there, a shortcut to control panel :-x

 

nealry kicked the cat ,, could not find it anywhere, another problem I found we dont have a darn cat :-o

 

but is a great tip for those with Vista and windrop 7, great tip Locutus

you also need to becareful of the size implications

 

the more things you have on your desktop [barring shortcuts]

the slower you pc will be to boot into your username.

 

if you have folders/zip files/documents etc etc [again anything bar shortcts on your desktop]

then it will go slower and slower.

 

just do a test

create a new user, time it till the HDD light stops going bananas.

the reboot and log in as yourself, it should be the same speed as a new user bar 10-15secs.

 

that'll get you all playing.!!!

Good point DX. This doesn't have to go on your desktop, can put it in "My documents" and then right click and Create a shortcut, then move the shortcut to the desktop.

I'll answer in the form of pictures then :p

 

OK, this only works on Windows Vista (32 bit) and Windows 7 (all versions)

 

Step 1, Right click in the location that you want this folder, and select new folder. It will appear Like so :-

Rename the folder to GodMode.{ED7BA470-8E54-465E-825C-99712043E01C} (just copy and paste that text, highlight it by left click and hold at the beginning of the G, and drag to the } so the entire phrase is highlighted, then press CTRL + C, then right click the "new folder" and rename, then delete all the text in the folder name and press CTRL + V) (you can replace "GodMode" with anything you like)

 

Now the folder will look like this :-

Double click that icon will open every setting on the computer, like this

Not quite.

 

Booting into any version of Windows for the first time on a new user will always take longer than normal as the profile has to be built.

 

Would be better to suggest to time it booting for the second time :D
