Unheaded letter also dated 16/11/20 from NewDay saying they assigned “all of the respective rights etc,”  to Lowell on 23/10/20 I make this 9 relevant pages from what I can see   ( all other pages are statements/default notes and lots of FCA info sheets) just needing your confirmation in advance as I don’t want to send over pages that are not required thank you  UCM      
    • Thanks Dave It's not too far away, about 8 or 9 miles, I will probably venture over on my bike if I can't think of a good reason to drive there again! I'll have a chat with Mrs GB_Joe tomorrow and see which shops they visited, I know M&S was on the list (had to try on multiple sets of trousers!) and they are actually in that bit of retail park. The uniform shop is across the way in the Meridian Centre, so probably not helpful to get them involved.
    • As they have failed to deliver their original PCN you will need to send them an SAR where they should provide that PCN. It should show the address they used . If it is not your current one that would explain the non delivery. If it was correct then perhaps the Post office messed up. A more cynical view would be that UKPC didn't send it so that you couldn't claim the reduction. It appears that UKPC have been there for some time  but I have been unable to find any pictures of their Notices.The leisure park itself is pretty big so while some parts maybe give 5 hours free parking other parts may have restrictions like permits. I haven't been there for years -I went  to Nandos and the bowling centre . I am surprised that they are now infested with UKPC as the place is plenty big enough not to require their dubious services. If you live not to far away it would help if you could get some legible pictures of their signs. Be carful to park in an area that doesn't require a permit and take photos of the entrance signs, the five hour sign and the permit only sign as well as any other signs that are different from the previous signs. Also if their is a payment machine could you please photograph that.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

You are correct, the Small claims limit is £750, Summary Cause is for amounts £750-£1500 but carries more cost to you if you lose.

You can sever your claim in to £750 chunks, by date, or by type of charge or any other suitable division you can think of.

The choice is yours whether to sever or go summary cause.

You can request your full amount of charges back in your preliminary letter and your LBA and then submit a claim for upto £750 small claims, then go back and start again fot the remaining amount when the first claim is settled.

Bank of Scotland round 1: £740 + costs settled, still sore over the 8% grrr

Bank of Scotland round 2: £629 +101.15 interest +£39 costs settled.

I think what the OFT actually said was that they would not prosecute Credit Card companies if they charged up to £12.

 

That being said the charges are simply not legal whether it is £12 or £20. I took on Tesco Credit Card for all the charges they had taken and won.

 

My advice, for what its worth, is to go for the full amount of the charges - the interest calculations only kick in when you lodge your claim at the court & not in any of the initial letters.

I have spent a few weeks looking over this site to try and make sure i am doing the right things. As i am claiming charges in Scotland, i belive that i you can claim up to £750 in the small claims court. Please can anyone advise, if its over £750 where do you start. Do you fill in a Summary Clause ?. I'm a little confused. Can anyone help me

Hi yes

 

for claims up to £750 you use Small Claims procedure. For claims between £750 and £1500 you use Summary Cause. As already been said, whichever one you use if your claim is over the £750 mark is up to you - you can divide it into however so many chunks of £750 or less.

 

Pros of doing it this way ie Small Claims - IF the case went to court and you lost, your expenses would be limited to a max of £75. It therefore costs banks much more to defend these actions than they'd get back in expenses even if they won, therefore notwithstanding the legal arguments it' s generally uneconomic for them to defend these.

 

Cons - if you are raising eg 2 court actions you would initially need to incur 2 x £39 in court warranting dues rather than just one. OK you would be able to claim this back but it could still be a consideration.

 

Conversely, while using Summary Cause procedure means you would only incur one set of court warranting dues, IF you were to lose the case in court the expenses implications are much worse.

not sure the small claims book works in Scotland, which I believe is where you are. However, you can lodge your claim through the englishcourts, if it is BoS you're after.

BoS:- D P A sent 09/06 Prelim. request 29/06 £1755 plus interest

1st claim Filed 5/10/06 SETTLED 19/10 £747.80 plus £534.31 interest

Can you please give me some advice - live in scotland and want to make a claim in court against capital one - someone else on here has stated that as they dont have an office here in scotland i have to submit my claim through an english court - is this correct?

Hearing date 04/12/06 - Halifax £399.62

Thats what I was originally going to do but I read a lot of threads and a lot more banks were starting to take ages to respond to the Data Protection Act S.A.R - (Subject Access Request) so I think even if you are going to wait until after your first claim is finished before starting another one it is worth DPA'ing them this now so you have the statements through and you don't have to wait ages at a later date.

Claim No.4:- claiming £1507.00, Court Papers submitted 5/4 !

28/09/2006 - Statements received through the post. Charges appear to be in the region of £2000 :eek:

Sorry but I'm very confused. I am raising an action against A&L for £1700 in Scotland. one thread says that I should divide this up to fit into small claims and other advises that this could be struck out which means that i would incur the court costs and asked to re file.

 

What should I do? if I take out a summary case how much will this be, will I have to get a solicitor and will I be able to claim the full £1700 on a summary.

 

Help is much appreciated! :confused:

Hi, Shearec.

 

You can claim up to £1,500.(Summary Cause) Then after they settle that claim, put in another(Small Claim) up to £750. Both claims will cost you £39.00. With the small claim the Court will do everthing for you. With the Summary Cause the court will return your papers to you and you will have to take them to a Sheriff's Officer to serve the claim for you, this cost me £15.97. All costs you can claim back from your bank. The court will send you a list of local Sheriff's Officers you can use. Why get a solicitor when you can do everthing yourself without paying out to much money, which you will get back.

Thanks so much for that. One more thing - sorry. do u know anything about the interest charged in the Vampress scottish schedule? I have added everything up and it's calculated the interest automatically which is interest on unlawfully deducted items but then adds judicial interest - can i claim both and for the judicial do I just add 8% to the full amount?

 

Sorry I just want to get it right first time and am a little confused and nervous.
