      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My husband has asset finance with BOS for his car, and over the last few months he has fallen behind with the payments.

 

They have not issued him with a default notice - yet, but what I would like to check is, if a potential DN he may receive from them contains their outrageous penalty charges eg £25 per letter, would this render any default notice defective? I know this is the case with just about everything else, I need confirmation just in case!:)

I've just received the most unprofessional letter from a company calling themselves Crystal Collection Ltd - it's so bad, it makes you laugh!!

 

The letter says: Would you please contact the sender of this letter as a matter of urgency on blah blah, to discuss the above agreement.

 

Now, I have a copy of the agreement they are referring to, (a complete cock up as the figures do not add up!!) the account numbers are completely different, although the vehicle is the same, so I shall do a CCA request as I have no knowledge of the agreement number they are talking about!!

 

A couple of other things. This account is in arrears, no fault of our own, just how things are business wise at the moment. The five year agreement is due to end in Jan next year, so not long to go, and as as a consequence we've paid more a third - so presumably they can't just come along and take the vehicle without a court order - we won't voluntarily terminate! The other thing is, we will be paying this off in full within the next month, so basically all I'm doing is fending them off.

 

The vehicle is financed via BOS Asset Finance, with GAP which I understand is non cancellable. The account must have numerous charges, as they were charging 25 quid for a letter - so I will SAR them and claim them all back, it must run into hundreds £'s!!

 

Has anybody else heard of this company - I've searched the forum and only found one thread. They are that thick, they don't know when you know who you are writing to, you end the letter "sincerely", there is no company reference number, and they surely they must have a CC licence, again, there's nothing on the letter. Should I complain to OFT??

I haven't ever heard of this company before, but I've posted this letter on another forum, but thought it could be appropriate here.

 

Just look at the letter head - where is the company registration number, and if they are a DCA, where is their CCA licence number???!!!:eek:

with a bos you are best hiding the car as soon as you can your ca and a bos are two differant contracts. so hide the car.

 

also the company you have listed you need to do a check on with oft to see if they have a credit licence. the company you have listed is not on company house (bells ringing)

Their website says they are members of the CSA, surely they would have a CC licence, wouldn't they? I can't find it on OFT website!

Hi just done a check on the phone numbers and it comes back as a recovery company hide your car today. you need to see a solicitor but your main thing is hide the car. it looks like your finace company have acted on the bos side of your hp. if they get your car you will lose everything to come.

Just for clarification Bank of Scotland are the finance company, the finance was taken out with them direct.

 

As far as the repo is concerned, and from reading around the forum, I would have assumed that I would have had a notice from the courts - I haven't. In order for them to make a bona fide reposession, then, if and when they attended my property, they would have to produce a court document, or would they chance their arm that there would be nobody at home!! Or have I got this all wrong???

 

Right, just read the agreement: Repossession: Your Rights.

 

"If you do not keep up to your side of the agreement but you have paid at least a third of the total amount under the agreement (we have), we may not take back the goods against your wishes unless we get a court order"

 

Right, so panic over - I'm at home 99.9% of the time, so if anybody does turn up, they can sling their hook!!

the royal bank of scotland do not issue bill of sales. did you get a lone from rbs direct (go into a bank)

 

you have had a contact letter from crystal. give them a call see what they say. but i would hide the car. you need to look at bill of sale. dont think you have rights (you do) but a repo company will take and you will have a bigger fight later. your car could go at 2am in the morning or next time you go shopping. you do need to hide the car TODAY.

You have misconstrued the OP's original post. There is no bill of sale, BOS stands for Bank of Scotland in this case so is a standard credit case, not a bill of sale case.

 

Also royal bank of scotland are completely different to bank of scotland!!!!!

Sorry CCTV, but I think we are talking at crossed purposes, it's not a bill of sale agreement, it's an HP agreement, I have it here in front of me! I think we were slightly confused with BOS - it's Bank of Scotland!!lol
