Hi all,

 

I'm just in the process of gaining planning consent for a loft conversion an while I await this I'm drafting a Party Structure Notice under the The Party Wall etc Act 1996 for my 'neighbour'.

 

The reason 'neighbour' is in inverted commas is due to the fact that property is empty and is currently sold subject to contract and has been for at least a couple of months.

 

So my query is where should I post the Notice to?

Hi I would imagine that the best place to serve it would be the estate agent.They would surely be in a position to forward it to the new owners,or else certainly forward it to the current owners should the agreed sale fail to materialise.

Cheers Martin, I have already sent them an email and am just awaiting their reply.

 

It's a bit of a tricky one as the previous owners have now passed away.

 

As soon as I hear back from the estate agent I'll let you know what they suggest.

Great.

 

As agents,they will surely be acting for someone-whether this be relatives of the deceased or in some other capacity such as Mortgagees etc.

Either way-they will know who needs to be aware of your notice,and It reasonable to suppose that it is in their interest (and any prospective clients interest) that they address this.

 

Consider for example if a sale was agreed and the new owners were not informed-but later learned from you that you had informed them prior to the sale yet they failed to disclose it....it could be quite compromising for them.

 

Hence I think they will act.

 

To cover all eventualities-I would put this in writing with proof they had been notified.

Okay, the agent got in touch with the vendor, our late neighbour's daughter and son-in-law, and basically we're going to have to wait for the sale to complete, which we've been led to believe will be very soon, as they wouldn't consent to the Notice been posted to them.

 

So the waiting game continues...
