Hi, my partner and i are renting a 1 bed room flat for £435.00 per month

 

My allowance for housing benefit is £115.38 per week.

 

and they pay 4 weekly

 

well £435 for weekly is £100.38 per week which is £401.52 every 4 weeks

 

however the council are paying us £461.52 every 4 weeks

 

 

i spoke to them today as i dont want any over payments.

 

 

they said to me, they have to pay my full allowance which is £461.52

i explained that my rent is only £435 per month and they said thats fine, that i could keep the diffreance providing its not more then £60 per month

 

£115.38 (£461.52) Allowance

 

Rent: £100.38 x 4 £401.52 - Diffreance of £60.00

 

are the council right in doing this, i cant see why the council would pay mroe then the actual rent of the flat and allow me to keep the rest.

Because under LHA at the moment if your rent is lower than the LHA amount for that size of property in that area you get to keep the extra money (up to £15 per week). So the Council can pay you an extra £60 every 4 weeks but if your rent was even less than it is you would still only be able to get £15 per week extra and not the full amount of the difference. This is a Government led thing as far as I am aware and all Councils do this.
