    • Yes. They won't inform your employer but you may need to. You need to check what it says iin your employment contract. I don't think it usually causes huge problems for most people. HB
    • Good afternoon. I've read a few threads briefly regarding a dmp with stepchange and was 95% complete with setting one up when I noticed the advice of letting things default instead and/or managing a dmp yourself. My current situation is the following £470 owed to Jacamo. Has not defaulted. Currently on a £10 payment plan with them for 12 months. Not sure what to do here £2700 owed to Vanquis - Credit Card. Has not defaulted and I have not missed payments. I am unemployed and even making a £200 payment from my benefit means £80 odd gets eaten thanks to interest. Guessing I let this default and then set up a payment plan after? £2500 owed to Lowell who bought from Very and passed on to Overdales after I ignored them. Last payment to Lowell was 30th November 2022. Plan here was to fight them in small claims court if it ever gets that far, assuming the worst. Any advice is very much appreciated, thank you.

    • Not prison, no. That has never happened here. I think they can look back a year on their system and you'll have something like TiredDodo did when they were summoned to court. With a year's use, I'll be amazed if you don't have a court appearance. HB

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have had to default on a loan to these people and having read through a number of similar threads am about to send this letter by recorded delivery, however I would quite like the forum to review it to check there are no issues.

Dear Sir/Madam,

I have recently received numerous e-mails from yourselves and despite making contact by phone on the date my loan was due have not yet had any personal response from yourselves.

I hereby confirm that, as per my legal rights, that I only wish to be contacted in relation to this matter in writing, and for the avoidance of doubt that does not include e-mail. No e-mails or telephone calls will be responded to although as a pre-cursor to a hard copy response, e-mails outlining your position will be reviewed.

Please be aware that at present I am fully aware of my rights and your obligations and retain the right to refer any and all matters to such authorities as I see relevant should I believe you are not acting in accordance with said responsibilities. These include, but are not limited to, OFT, Trading Standards, FSA and Financial Ombudsman.

 

I hereby inform Wonga.com Ltd (trading as Wonga.com) that I place my account in dispute, and that no means available to Wonga will force to to pay the additional interest and charges which I find unreasonable and unlawful. I consider the amount owed to Wonga to be £xxxx.xx

Furthermore, I am sure you are as aware as I am that any attempt to suggest a “doorstep call” will fail, as such a visit can only be subject to appointment and I have no wish to make such an appointment.

 

There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, your representatives or other assigned third parties to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

I wish to arrange to make an repayment agreement with yourselves which is reasonable given my present circumstances. My personal circumstances >. Additionally the court fine now due is of higher priority than your own debt.

I hereby offer you the opportunity to agree a settlement at a rate of £100/week in order to meet the repayment of the loan. This will settle the loan of the original amount + original interest within 3 months. I will only agree to this if you confirm that interest and charges on the loan will be stopped from the due date, which is the date I first made contact with your call centre and was assured I would be called back to discuss the matter, a call I am still waiting for.

Of course if you believe your charges, interest and working practises to meet the OFT's fairness guidelines and that my attempts to resolve this matter are unreasonable it is your duty to apply to the court to hand down a ruling. However, as I believe this is not the case I ask you to forward your bank details such that I can create a standing order in your favour and initiate payments.

hi i too had problems with wonga they started taking money out of my bank account with out my permission and my bank account went overdrwn because of them. EVERY TIME I TRIED calling them i would get cut off when eventually got through to them they were not very helpfull. I am now in a repayment programme with them on the understanding that i pay every month on time otherwise the repayment programme will be nil and void and i would have to pay in full the outstanding amount plus interest. The loan i originally fell behind with was only 300 but now its up to 600 and interest is rising.

Hi blue angel, did you agree a repayment with them over the phone or via email/post? Have wonga stopped putting interetest on because your in a repayment plan?

Hi again! Please, please, please could someone advise me of the address they have used to send stuff to Wonga. Looks like various people on the forum have sent them stuff, can one of you advise?

 

I am guessing it's probably 28-32 Wellington Road, London, NW8 9SP ?

 

I say this as I suspect the Crawford Street address is postal only. No respectable business would want them in that area!

 

Also, interestingly I found this - http://www.affiliatewindow.com/documents/merchants/1889/Affiliate_Window-Electronic_Wonga_Affiliate_Agreement-5_Dec_09.pdf, which also suggests 28-32 Wellington Road, London, NW8 9SP is a "Billing Address" and even includes a persons' name, how about that?!

Thought I'd update for anyone interested. I have given up with the idea of sending anything by post and instead created a secured .pdf file (so the contents could not be tampered with) and sent it as at attachment to [email protected] this morning. I have received- an e-mail back:

 

"In order to agree a repayment plan, a collection advisor will need to assess your current financial situation. Please do not hesitate to contact us on 0844 842 9109 as soon as possible to come to an mutual agreement"

 

It goes without saying I wasn't going to play ball and have replied:

 

"To whom it may concern,

 

Thank you for taking the time to read and reply to my letter. However, you seem to have missed one of the points. I clearly stated that I had no desire to enter into any telephone conversations with Wonga and that all communications should be in writing. Obviously, as I have been unable to send a hard copy of the letter since you are unable or unwilling to supply a valid address, we are now communicating via e-mail rather than in writing, which is not as satisfactory as I would like, but at least you are now communicatiing with me, so that is some progress. However, the fact exists that I do not wish either party to contact the other by telephone and remove your right so to do.

 

Regardless of the fact that I have no legal requirement to supply Wonga with details of my financial situation, I have already outlined it in the letter previously sent. You also already know my standard salary, as it is a requirement of the original loan application process, Working out that I am taking home half of that, and have the fine to pay should give you all the information you need. Even if I had not given these details, cleary presenting the figures in writing, such that both parties can see what is what is a far less ambigous method of confirming the situation than a telephone call, so that is the second reason why I will not be taking you up on your offer for me to make contact by phone.

 

Once again, I request you confirm your agreement with the details included in my letter of 8th April 2010 and forward your banking details to me so I can set up a standing order. It should be quite plain to see that I am clearly making an effort to resolve this situation (as I have been since the loan was due, including calling you to discuss the matter on the due date) and that it is Wonga who is delaying the satisfactory conclusion of this matter. I am sure this will be duly noted by the relevant authorities in the event that the situation needs to escalate to them."

wonga passed me to barker and lowe about a month ago, iv had letters from them demanding payment, i phoned them yesterday and arranged to pay monthly for 12 months which i have been asking them to do for ages by email but they just ignore emails, once i phoned them i sorted it within about 10 minutes

You should get acceptance and agreement to your repayment proposals in writing-just in case you need to show that they agreed later.

As we continually stress-its not good to deal by phone-these things should be kept in writing.

My reply:

 

 

"Thank you for your e-mail today, however once again, I must point out that although you are replying to my communications, you seem to either be ignoring, or failing to understand the content. I attach a copy of my original letter and my previous reply.

 

I will re-iterate that, as per my legal rights, I have no desire to enter into telephone conversations with Wonga. I see no reason why you persist in attempting to arrange such a call. The entire loan application process requires no such communication, so I fail to see why you beieve it is now required. An e-mail or better still hard copy of an agreement would remove all doubt of each party's responsibilities and provide a more substantial audit trail of activity. Wonga continues to be unwilling or unable to use postal mail as a method of communication. I have furnished you with full details of my proposed repayment schedule and requested your bank details to set up a standing order. Wonga has failed to respond as requested. You simply need to confirm acceptance of this and forward said details.

 

As I have also previously stated I place the account in dispute as I believe the additional charges and interest being applied are unlawful. Additionally, it is I that have initated contact to resolve this matter on the day the loan was due, and any such interest you are attempting to apply is primarily as a result of the failure of Wonga to reply in a timely fashion. I replied to your last e-mail within 28 minutes of receiving it. Your reply to that took 4 days, albeit that that period included a weekend. Additionally there is no legal requirement which prevents you acceding to this request prior to an initial installment. The full amount I believe due and am prepared to repay is £xxxx.xx. Should you wish to attempt to recover amounts above and beyond this you will need to follow due process in court.

 

Therefore, I conclude by asking you once again to supply the bank details I require so I can start making repayments from Friday 16th April 2010."

i never got that email about the £100 a week, i agree that things should be kept in writing and i am definately going to get the agreement in writing before i make any payments, i was just getting really annoyed with them ignoring me i replied to every one of their emails.

Well, well, well, 2 days have passed since my last e-mail back to Wonga, asking again for their bank details, so I can start a repayment plan tomorrow (Friday) and ... nothing!

 

I have just sent them another e-mail, so if it ever gets to court (unlikely I know) I will be able to show clearly that I have been attempting to kick things off and that Wonga have failed to assist me in this matter. I wonder if that's so they can add more interest and spurious charges? Not that there's any point in that.

 

"Dear Sir/Madam,

 

I e-mail you again, as two days have now passed with no contact from you. I am surprised by this as I would expect you would like this situation resolved as swiftly as possible? As previously stated I would like to commence a repayment programme starting tomorrow (Friday 16th April 2010). However, despite all the details I have supplied and my continued chasing, I am still without your bank details, so cannot set up a standing order. Please be aware though, as per my previous comments, that I will only commence repayment if you confirm in writing that the due balance is solely that of the original loan amount & interest, which was a total of £xxxx.xx, and that no additional charges or interest will be added."

REPLY:

 

"Thank you for at least partially replying to my e-mail. I do indeed now have your banking details and thus can start to make payments. However, you mention again that you wish me to call you to arrange repayments, which I have explained before that I do not wish today as I do not believe both parties are not adequately safeguarded. You also mention you tried to call me, which is in contravention of my previous requests, and totally unnecessary given we have an open line of communication. I am sorry you feel £xxxx.xx is insufficient, but as stated before given Wonga's complete failure thus far to assist me in a timely fashion with reaching an agreement is all I am prepared to pay. I dispute the figure of £xxxx.xx you give as I believe it is unfair and unlawful owing to the additional interest and charges you have levied.

 

As I now have your details however, and I do not dispute the original amount owed of £xxxx.xx, I will make payments every 7 days from tomorrow of £100 until that amount is repaid. Any further amounts will remain in dispute and will require relevant court process to determine their status.

 

My bank now operates the faster payment service for one-off transactions and thus you will actually receive the amount in your account the same day, not within 3-5 days as you state below.

 

In the meantime, I look forward to your confirmation that £xxxx.xx is the genuine total of the debt for which I am liable."
