      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

Came across this site about a month ago and decided to find out how much the bank took from me in charges. When I was a student about 2 years ago I got a lot of charges to my current account, I was thinking about £200-£300 in total. I was totally gob smacked when I got my statements in and the total charges before interest was £2,386!!!

 

Sent of my prelim letter on 17/08/06 so hopefully I will hear something shortly!

Heard nothing back from my LBA so I am going to go down to the local court on Monday and make a clam.

 

However I think I have made a wee mistake. The first charge I am claiming for starts on 29/01/01. Because I am in scotland I can only claim for 5 years, what date should I use as starting 5 years from, the day I sent for the data protection act?

 

Any advice would be great :-)

As far as I know BOS like HBOS has an English office so you could claim through english courts. Then you can claim the 6 years and saves you puttung multiple claims in with the scottish limit being £750. If you have an address in England you can use then you can claim via moneyclaim online, otherwise you need to fill in an N1 form. For 5 years in scotland, I think it dates back to 5 years from date you requested statements so break them down into chunks and start the first claim, by the time you get to the most recent one you may even have more charges to claim back...

Thanks for that.

 

What I am going to do is just break it down into claims of £750, I have calculated the 8% interest and going to fill out the court papers today and hand them in on monday. Would someone be willing to look over the papers etc before I submit them to the court. I am really worried that I am going to make a mess of it!

When I handed in my claim at the Sheriff Court the lady behind the counter went through everthing, she even changed things that I had got wrong.

You could file a summary cause. This allows you to claim up to £1500. The only difference is that if you lose at court you have to pay their defence fee's. As we all know this is very unlikely to go to court, but it is your decision. I filed a summary cause at the sherrif court and got a settlement within 3 weeks.

I Won!!!

 

Got a letter this morning saying its not in there interest to pursue the claim so they are paying £735 for the bank chanrges, £260 for the interest and £39 court fee's to my bank in the next 7 working days. Total £1,034 :D donation will soon be on its way.

 

I am going to send the bank a letter saying that this claim was part of a bigger claim and I will be pursing the rest. They have 7 days to pay the rest of the money in full else I will be submitting another court claim. Is that the best way to do it?

Are we talking about charges applied since the claim started ?If so send them the letter yes.Its worth a try but you may have to run another claim.

Yes I do.

Get the prelim out ......no reason to wait.

Am certain they will not refund the earlier charges without court action.
