    • ive already CAREFULLY explained how it all works earlier. what you will have to pay is already preset and detailed on the court forms/TfL stuff you already have. you wont be asked any questions upon your financial means etc. thats not under debate . you wont be asked upon any mitigating circumstances, you have pleaded guity which you always SHOULD.  the ONLY 2 reasons you are attending is to: 1) after finding the TfL prosecutor... plead directly face to face before you go in to try and get an OOC (you can bring up or say anything/everything you like ...anything that might get them to agree) 2) if 1 fails...show your genuine remorse face to face to the magistrate, BRIEFLY mention how a criminal record would hinder your future then hope they take pity on you and dont also record this on your file.  PS its only declarable/shows there for one year anyway. regardless to what an employer might ask in job questionnaires past 1yrs you forget about it. they cannot see it even on enhanced DBS etc etc. you should not latterly ever appeal a criminal record for this type (1yrs)  of 'offence' its not worth it and if you lose said appeal it will cost your dear in terms of additional wages grabbing and court fees. and extends the time it shows if you lose too. dx  
    • hit letter of claim follow post 2 despite repeated requests, the claimant has failed to produce any enforceable paperwork.

I was very sorry to learn that you recently received a parking charge notice after shopping at our Kearsley Manchester Rd Express store. I appreciate this is always frustrating, especially as you'd just nipped in for the one item. I've had a look, and I can confirm that in this case the car park at this store is entirely owned by a third party - it is not owned or operated by Tesco in any way. The parking charge issued is on behalf of that third party, although I appreciate it does state Tesco on the letter. Regrettably as the car park is owned and operated by a separate company we don't have any form of influence or control over the parking charges issued. In this case, I can only recommend that you follow the appeals process outlined on the letter directly to take the matter up with UKPPO directly.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

...today, I was depressed as I was being chased for a debt I was paying at a rate I couldn't afford to the Leeds Losers.

 

In desperation, I googled Lowells and up popped the Consumer Action Group.

I had never heard of the CAG before so had a quick peep.

 

Suffice to say, since that time, my depression has gone, my knowledge has improved (still a long way to go) and I have a little more money in my pocket.

 

With the help of loads of people who give their time freely, I have seen off the Lowlifes, had a remaining debt of £750 written off and surprisingly, the default has vanished too??

 

I am also happily fighting Cabot as they no longer scare me, even with their silly letters. (they have my phone number but don't ring me :()

 

I can't say thankyou to everyone who has helped me over this past year as this post would be huge but you know who you are and you need to know how much I appreciate all your help. Without sites like this, I am sure there would be many more tragic stories in the press about someone taking their lives because of the tactics used by debt collectors.

 

To mark my one year anniversary, I am off to the east coast to visit my family so if I don't reply, that's why.

I've been here over 2 years, found CAG when working for Barclay's and I was reading up on the bank charges news (and realized that the banks were in the wrong!). I don't post much on the debt forums as the only debts I had, I sent a CCA request and they went away, so I'm not that knowledgeable on the subject. I know a bit about IT and telecoms as I've worked for a few companies in this field so I stick to them forums and bear garden mostly. Most of you probably know me as "the guy that does the youtube vid's to fuzzybobbles phone calls"

 

The difference CAG has brought to my life.... Well, to begin with I'm debt free. I feel great especially 1 debt (the biggest I had, £5000 ish!) that I had PPI on that the lender said was invalid :mad: so I was paying more money to pay off the whole loan at that time. If they'd been fair to me I'd probably still be paying that now :p My other half had depression, made worse as income generally didn't cover essential bills never mind having fun! we've got that all covered now!

 

Last month a Fixed Rate bond that I had matured so I got a couple of £1000's. This was going to be used to clear my debts, but instead I got a few niceties, I'm going to pass my driving test (no matter how many times I need to go in for it) and I'm going to get Microsoft certified as a desktop support technician. I also sent a little donation to CAG for their help with the CCA requests, and once bank charges start moving again (preferably in my direction) I'll make another donation. Once bank charges are sorted, my credit file have no nasties on (as my old bank still shows in the negative!), and I can seriously think about a mortgage!

 

2 years ago, I was £5,000 in debt, Not very happy with life (as a father of 3 girls, my partner and daughters were the only good things in my life, and I felt I'd failed them) and money was due out before it was due in with no end in sight!

 

Thanks to CAG (and a little hard work by me :p) everything has turned around! I'm going to get a much better paid job, I have a little bit of money put aside and the future looks much brighter!

 

So, Thank you CAG, Cagers and everyone who has donated! Without you guys this site would not exist, and without this site I cannot imagine where I'd be now if life's ever decreasing circles had continued!

Thanks for that Silverfox, you’ve given me a lot of hope by what you’ve said. I was in the same place as you a year ago and sadly still there, but slowly getting round to dealing with things now, owe c.£50k and no way to pay so will battle on. Really nice to know that there is light at the end of the tunnel. Well done for getting yourself out of trouble.

 

Ditto what you say, thanks to all CAGgers who’ve helped me too.

For me it was just over a year ago, it started in July with a SD from Ist Crappit....no warning letter, just a lovely SD threatening me with bancruptcy and all that would entail.

 

I was so scared, If I am honest suicide was considered....for about five seconds and then the thought of my daughter picking up the pieces shook me back into sanity. I realised I would have to deal with it and googled SD's, Ist Credit and Connaught (as they were supposedly the debt collectors who gave Ist Credit the go ahead to send the SD) and up came CAG my saviours!

 

I suspect I was like every cagger reading the posts, wide eyed at the information held there and then tentatively making my first post and hoping someone can help......then the posts come flooding with sound advice, encouragement and for me the most important thing was that no one judged me for being in debt!

 

I dont donate as much as I would like, things are a little tight at the moment but will definately donate again in the new year.

Now I'm not really here. this is a figment of your imagination as I said earlier I was going over to see my family.

This is how commited I am (or should that be committed to an asylum) as after a 3+ hour drive from the east mids to suffolk I nick her PC to see what is going on in CAGland

I would have got here earlier if it wasn't for all the idiots on the road (except me of course:D)

the only thing is that now i'm here, my daughter will get me doing stuff. i'm already booked to repair a wardrobe then shopping and i'm sure more to come.

going to see my son in norwich soon.

Nice one Silverfox... tonight I got home to a lovely letter from London & Scottish who repossessed me (its the third anniversary this month so I now know it is a 'routine' letter which will be ignored). There isn't much else anyone can do except make me bankrupt. I won't loose my job if I am bankrupt so it isn't a major problem.

 

I don't get phoned up now by anyone who can get through, (re-routed several phone nos to other DCAS - love to hear the conversations!). I am almost debt free in other ways and challenge every single alleged debt which comes in, surprising how many have given up completely now!

 

I doubt I would be this far along if it hadn't been for finding CAG after a ****** bailiff tried to fleece me. Googled and ended up here.

These people are ruining ordinary peoples lives just to make money and then balance their books :cool: yes I was there too myself and love helping people out of that awful black hole :).

Hi silverfox, excellent thread to start. My anniversary was in June. I still have many battles to fight but am no longer scared to answer the phone (I actually enjoy it). Friends on CAG have given me the confidence to face all the things that had been hidden for years. My nemesis was 1stCredit, to whom I owe a debt of gratitude, even if they have just reared their ugly heads again.:p

Morning all,

After a lovely weekend with my son and daughter and a horrid drive home :mad: I came here and saw all the wonderful messages. I got this warm feeling (and no, I didn't wet myself again:smile:)

Since I arrived here, I checked out other forums and saw just how many peeps got flamed for trying to get themselves out of debt.

This does not happen here (much) which is one of the many reasons I stick around. The comradeship and general friendliness of peeps here is inspiring to me. I have the privilege to call a few of you my friend.

CAG has changed my life, I love helping people now who were going through what I went through and I have met lots of nice people on here. When I was in the depths of despair with my debts and charges and did not know what to do I felt I had no-one to talk to. I thought I was the only one going through this, if I mentioned my troubles to people then I usually got a superior sneer and more or less told it was my fault. I cannot belive how many others were in the same boat. I will never be rich but at least I am comfortable now and I will never let any creditor or bank bully me again. I still go cold if I go home to a pile of post even though everything is up to date now. Thank you CAG

No need to preamble as you have, "been there, Done it, and got the proverbial............

 

But, I am just starting out to remedy my previous misdemeaners which,

I dont mind doing if they were to play fair .

And despite all the "BULL" about....

 

"if you do get into trouble, tell your lender straight away".

 

Yes tell them.. their smiles get bigger by the day. charges for this charges for that, administration costs for this that and the other Late this and That not to mention the collection "costs" even if you manage to pay them.

Well its time to play by the same RULES that they do. You know the ones they DON'T want you to know about.

 

When I first asked on this site for help you were one of the first to answer me.Just to have someone encourage you or point you in the RIGHT direction gets you to be able to think strait.

Then you know you are doing something positive and ARE on the right track. This MUST apply to so many also in my situation ..

 

So thank You so far...
