Hi, can anyone tell me if I am still able to claim housing benefit if I am renting a flat from a relative?

Nothing in the law prevents it, at least not that I know of - I've been wrong before. But make sure your tenancy agreement is watertight and that you can prove you've been paying rent.

 

And as Andrewquinn says, they are likely to scrutinise your claim much more than normal.

Absolutely, they will want to ensure that it is a real tenancy that you would have equally given to non family members, it is a true commercial relationship, ie, it is not a contrived tenancy with a view to gaining housing benefit! & you would have to be in receipt of IS/JSA or on a low income, including tax credits, but you must not have capital of over £16,000. If you have £8,000 - £16,000 there will be a reduction.

 

Mind you some councils insist that you have a commercial/buy to let mortgage as well, so check it out!
