      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This is proving a very helpful site for me. I didn’t have a clue I could claim my charges back so I’m very grateful for all who have helped (helping) me sort these buggars out!

 

I asked for my statements at the bank on Fri. 16th June, I paid cash (5.00) and they said it will take up to 10 days. Meanwhile I noticed the cheeky buggars had charged my account 5.00 too.:mad: My account is already overdrawn so I would get the 38.00 charge for unauthorised O/D too. But I put that right when I phoned them and yelled profusely.

 

So I now have my statements and totted up a total of 1300 quid in charges and interest but I have 2 accounts with the same bank so I’m just waiting on the other statements to arrive then I’ll send the request for payment letter. I’m thinking the total will be around 2000 maybe a bit more.

 

I am currently going through the default stages (well have been since January and been charged 4 default fees at 30 quid a time) so I will also be asking to take the default off too.

 

Has anybody else had their default removed? I have looked through the FAQ's but not seen anything yet

OK, i got my statements for the last 6 years (i am claiming on 2 accounts). I have filled in the spreadsheet and have a total of 2319.95. I have just printed off my prelim letter and going to post it tomorow.

 

I have come to realise that this process is not as straight forward as it seems. I have spent hours reading the FAQ's and think i know what i have to do, however i'm bound to run into some problems somewhere along the line but it seems there are many helpfull folk out there, so thankyou to you all ;)

I just went into my local branch and ordered them for 5 quid, the first lot (i'm claimin on 2 accounts) came in 5 days, but the second took about 2 weeks and they charged me twice! if you dont recieve them in 5 days ring and nag em.

well its been 14 days and i haven't heard a peep from anybody. so on monday i will send my lba letter. not sure what to do if they say they didnt recieve the first one. was i supposed send it recorded post or what? i expected to have a fob off letter but i ain't got owt.

Is the address that you used the registered address of the royal bank of scotland. Im not sure if you are supposed to put a named person on the claim for companies ie in the name box just put Royal Bank of Scotland. I guess this is incase the person you put in goes on leave or quits the company.

im ready to file my claim but if i do it online i cant get the exemption (im on tax credits) i have forms from my local court i just want to check if i do it the same way. and also where i post the claim to (bank) as all the addresses i have seen are in scotland

i need to file my claim but the intrest area on my spreadsheet just says "VALUE" where the amount should be. is there something wrong with the formulae on the sheet? has anyone else had this problem?

Hi Louise ashton,

 

the formula for the total should be, =sum(C10:C118) if your using the simple excel one, like i did, you can type it in yourself, click on value and enter the formula in the bar at the top.

Sorry louise, got that wrong you are further on than me, is it the daily interest you are trying to calculate?

 

maybe you could help me, did you include your charges interest in your first spreadsheet you sent, and did you apply for overdraft charges?

The defendant filed an acknowledgement of service on 03 october 2006

 

The defendant responded to the claim indicating an intention to defend all of the claim.

 

The defendant has 28 days from the date of service of the claim form with all particulars of claim, or of the particulars of claim, to file a defence.

dont panic this is standard, just wait for the defence it will be the usual rubbish from Cobblers!! i have just won against them today for £1954.95. :D

Don't panic! Cobblers always say they'll defend, but they'll back down before it gets to court. You can't be charged if you lose as you're on the small claims track. But check some other threads for legal advice (my claim didn't get that far so I can't really advise). Look at Big Col's - he has a wealth of information on his thread. There's not a lot you can do as far as the claim is concerned now, just sit tight and wait for Cobblers' next move. In the mean time read everything you possibly can on this site, so you know where you stand. You'll soon see that most claims follow a pattern.

 

My advice - stay calm and keep reading!

You can apply if they miss the deadlines to submit paperwork etc, but Cobblers wont they just file on the last day!!! :-x

BoS completely ignored my claim. Just make you contact court on any date they've specified and someone will help you. From my experience the courts are very helpfull- willingy to give idiots guide!

Halifax: £478 (+ interest & cost) reimbursed

 

Halifax Visa: £370 - 1/2 back so far

 

Bank of Scotland: £802 (+ interest & costs) court ordered to pay (BoS failed to respond)
