No real story just a few charges going back over the years for unpaid direct debits. the most recent being a charge of £39 for a £2 direct debit to cancer research. my account was 37p short. I have refused to pay and moved all my account incomings to Nat West

Got a letter in the post today

 

YOUR RECENT COMPLAINT

 

I refer to your recent letter, which I have received today. In order for me to deal with the issues that you have raised, I have today requested full details of the charges that have been applied to your account in the past six years

 

I can assure you that on receipt of this information I will give this matter my full attention and will contact yourself in due course.

 

You will find enclosed a copy of our leaflet, which tells you how we will handle your complaint.

 

Your concerns will be dealt with as quickly as possible, but if you need to speak to me in the meantime please do not hesitate to contact myself on 017XX XXXXXX.

 

Is this fobbing off or are they starting to give in without the fight?

If you sent the letter before action then on the 14 day, phone them and ask if they are refunding the charges. if he say yes (cool) if he say we need more time then I would say that fine but I will be submitting the claim to the court tomorrow. Then submit the claim form on the 15 day!

Phoned the branch today and spoke to one of the managers who told me that they hadn't managed to get information regarding specific charges as yet but had my statements for the last 6 years and was currently going through them but was finding it difficult to accetain what the charges were for. Appears to be a bit of stalling for time but at least they could be moving in the right direction

got all my statements in the post today for the last six years without any request for payment of them plus a covering letter

 

I write with reference to my letter dated 8th February 2006. I have now reviewed all charges applied to your account over the past six years. I can now confirm that all charges were applied eithin the terms and conditions for this account and in no instance is there any eveidence of the Halifax being at fault. In view of this and after careful consideration I do not feel that I am in a position to refund any of the charges incurred.

 

Should any of your concerns remain unresolved please let me know what you'd like me to do to put matters right. We are keen to resolve your concerns, if we are unable to do so we'll provide you with details of how you can contact the Financial Ombudsman Service for help. If I don't hear from you in the next eight weeks I will assume you are happy.

 

 

What I expected really but now I know how much which completely gobsmacked me £1200 my letter threatening court action will now be posted

Got letter back from the courts this morning. Halifax are defending all of the claim, so hopefully it will only be a matter of time before I get the obligatory we are not giving in but are paying to avoid costs letter. But can't help feeling a tad nervous now

Just had my letter from Lloyds - not paying up - so am in process of doing the last letter - LETTER BEFORE ACTION - giving 14 days.

 

With Halifax - havent heard a bean - 14 days due on Friday next (21st). Await with baited breath every time postie comes - he is getting into it as well.

Case SETTLED. Halifax paid up in full today with the usual we are not admiting liabilty letter but to defend in court will cost us more money. £1605 in my account today. Over the moon. Book tokens will be on their way.
