      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all! After many weeks of reading this wonderful site, buying the very helpful "Small Claims Lawpack" Trawling through the FAQ's and Threads for RBS. I feel ready to go. My first letter requesting statements is sat next to me waiting to be posted tomorrow (or rather later today) recorded delivery. I am one of those people who sits back and thinks about what I should do instead of getting off my arse and doing it. You have all inspired me, and with your support and my imminent wedding in Vegas in December, as my goal to having this all sorted .... I'm raring to go!!:)

If you feel ready to go, and are happy that you know the procedure you're entering into, then you're right about having to get off your bum to get going!!!

 

No-one else will do it for you, and of course this site is a self-help site for that very reason ... you should already be aware that we all love to help each other wherever we can, but the final action is down to you!

 

Of course, you could just snuggle up in the armchair and let your bank keep fleecing you ... but I reckon you'd probably prefer to get some money to go towards the wedding in Vegas.

 

(Promise you're not relying on the tables there to make your fortune so you don't have to worry about the bank again?).

 

So if you're raring to go ... GET UP AND GO!!!

 

Post off your SAR letter TODAY, and post a new thread with your on-going progress or questions in the appropriate forum ... youll get plenty of support and guidance ... but DO keep on your own case as well!

Right!! I have been a bit in active with regards to keeping my own Thread going but I think I need to set it up again, cos this is getting interesting now!!! Sent off all relevant forms been offered usual amounts of money, filled out MCOL. Cobbetts offering me money still pursuing. Then the fun begins.... Got another £38 charg, when there were sifficient funds still in my account!!!!! so thought I'd write to my branch again asking for it's recovery.... many weeks later I get a reply from Head office saying the usual blah blah blah and offering me £633!!!! I have written back explaining that I was only asking for the £38 but if they are referring to the current ongoing claim awaiting a court date, for £2436.99 plus interest plus costs currently standing at £220. Thanks but no thanks! awaiting a reply from them about this...... However, This morning I get a letter from the Courts asking me to attend a preliminary hearing on 30th May because "Special directions are needed in this claim to prepare for the final hearing which the judge would prefer to explain to you in person"........ I'm not quite sure what this means or what I should take with me to prepare. Has anyone else had this? I've checked out the site and others seem to have been given direction on what may happen!! but my judge is keeping it secret........ All very exciting! :D

:smile: I Haven't kept a thread going but now I think I should as things are happening!!

 

All the usual letters have been sent and now at the Court stage through MCOL.

 

Last month I received another charge of £38 and a DD refused when I had sufficient funds in my account:mad: So I wrote to my branch asking why? a few weeks passed and I received a letter from "Sandy" offering me £633.00! which was very nice considering I was only aking for my £38! I replied Thank you very much but if this is for my current claim awaiting a court date for £2436.99 plus interest ,plus costs at £220 then no thank you! Still awaiting a reply.

 

This morning I receive a Notice of Allocation to Small Claims track asking me to attend a preliminary hearing on 30th May as "Special directions are needed in this claim to prepare for the final hearing which the judge would prefer to explain to you in person" This is all very intriguing, and I'm wondering if anyone else has had this? I've read the other notes about prelims but can't find anyone who has had this! Can anyone enlighten me please?:)

I've read this statement twice this morning in the RBS forum so they are definitely around. Why don't you copy the statement into the search field and see what comes up? ;) I wouldn't think you are the only person who has received it - your the second I've seen in a matter of minutes so I would think the forum is brimming with people at this stage.

 

Furthermore, there is a "bringing your case to court" thread in the FAQs which may or may not be of help. I've never got as far as going to court so am unfamiliar with the process so don't know if this is beneficial or not, just posting in case it is!!

And there was me thinking I was special!! lol. I've really kept my cool right throughout this process, but now having a date of 30th May.......so far away, I started to panic a bit. Just have to use my time to get myself up to date with the court bundle etc etc.. Kind of looking forwards to it now :eek:

:lol: Special delivery cheque this morning, for the whole lot = just under £3k... I can't stop :grin: . Keep at it all.. it will come good! Yorkshire bank next!! and just discovered my 18 year old daughter has loads of charges with the Halifax... I'm on a roll now!! The feeling is good! As soon as cheque clears I'll make a donation to this wonderful liberating site!!!!!!!!... HA HA HA HA!! YEEES!:lol:

Thank you so much! You all work so hard for us. The knowledge and help provided on this site is phenominal! I certainly will stick around, think I'm addicted to the site now... As for the money! It will be used to pay off some of my large debts! mind you I am away to Gran Canaria on Wednesday.. mmmmm let me pour myself a glass of wine toast all who use the CAG and see if i can squeeze a little of the cash to spend on ME!... ive currently got a claim going for £2k with barclays and have just sent the LBA, and ironically, now have £260 to claim back from RBS - the very account I set up as a parachute account in case Barclays started playing nasty!

ah well, by the looks of things, RBS seem to be a lot more amicable (and pay out sooner) than Barclays, so thats good at least.

Unlike my Barclays account, I actually like RBS (or what little dealings I have had with them,) as they seem to be really helpful.

however, my opinion may well change....

08/02/07-Prelim letter & SOC sent to Barclays

22/02/07-LBA & updated SOC sent to Barclays

23/02/07-Prelim letter and SOC sent to RBS

05/03/07-Offer letter recd from RBS - full settlement, no conditions. Accepted

08/03/07-Paid in full from RBS:D

12/03/07-Offer from Barclays - less than 1/3 of the full amount, rejection letter sent with updated SOC:mad:

26/03/07-Claim #2 against RBS...Prelim letter and SOC sent (same account, more charges since settling last claim!)

18/05/07- recfd offer from RBS for full amount claimed, accepted!

25/0507-recd offer from barclays for full amount!!!! yippee!!! acceptance sent

26/0507-recd letter from barclays saying that they have closed my account???? help!?
