      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Recently applied for a loan of £10,500 to consildate my finance, i have a below average Credit score, hence the reason applying at Wentworth.

 

Typyical APR is 15.2%.

 

I applied last week and have recieved no mail from them but recieved a phonecall today stating that i HAD been accepted and that there was a lender in place who had accepted me. Over the phone they gave me the actual APR of 15.x% and monthly repayments of £241.xx over 60 months. They told me the actual lender would be Wentworth themselve's, is this possible from an actual broker firm??

 

They then proceeded to tell me there was a brokerage fee of £55.

 

I have a feeling this could be [problem], just to get a fee out of me, but they have stated all of the above, any advise from anyone who has had dealings with them or anyone in the 'know' regarding broker companies, any advice would be appreciated.

this is a yes loans [problem]

 

prepare for loads of texts from debt management co and loan co

 

wentworth has some dodgy connections i believe with some dca or cra

 

cant put my finger on it at the moment

 

contact wentworth and tell them to deleate all personel info

Thanks for the speedy reply's, much appreciated. It seems everywhere i look on the internet there is a bad word to be said about that company.

 

I will not part with my £55, except of course if they get me the loan then ill agree to pay the fee once my funds have been cleared......

 

Wishfull thinking me thinks :-):-):-)

I have also been ripped off by them.

 

They said i was accepted i paid my £55.00 and have now been told

i have not even tho my credit is good.

 

I have sent a letter and spoke to certain asociations who advised what they are doing is illegal.

 

I have also forwarded a letter to them advising them action can and will be taken against them .

 

I will let you know how i get on

I'm so glad I came across this thread, ironically whilst searching for Wentworth number to pay the broker's fee! As they even printed the wrong number to contact them on the letter I have received. It seemed a bit strange that the number I was dialing from the letter just didn't get anywhere.

I will certainly not be parting with £59 even though am desperate.

One question, can anyone recommend any goods Cos offering loans? especially for someone who hasn't got grate credit?

it is disgraceful that in this day and age companies are allowed to perform like this without recourse - i have reported these sharks to office of fair trading but they still seem to be running thier scams. i know first hand how difficult it is in getting credit when your score is low but if it is repayments on credit cards or debts there is things you can do and a really good option is to find your nearest credit union and start saving with them you can save from as little as £2 per week and they also offer loans at really good rates - if anyone wants further advice just post a message and i will do anything i can to help

Wentworth keep telling me they have lenders ready and waiting to accept my details, and I have told them to get lost and stop hassling me.

 

They don't seem to understand that I do not want to pay a 'broker fee' or an 'acceptance fee' and that I do not want to consolidate, borrow or go into an IVA.

 

Eventually they will give up - Loanfinder eventually stopped getting Tara to email me and so did Loans To Go, Loan Warehouse and various others.

 

I still believe some of these are a thinly veiled attempt to get you to update your details to Experian and other similar organisations.

 

IMHO they should be closed down.

it is one of the worst aspects of getting mixed up with these people is the continuing hassle of phone calls, all i did was without even confirming who i was ask who they were and as soon as they told me who they were i just hung up - it worked as within a few short weeks they all stopped calling!!!

My wife applied for a loan and was told that they needed her credit card number for identification purposes only, and they assured her that no money would be taken. The following day my wife rang her credit card company and was told that they had tried to take £59.00! Luckily the card was already maxed out and so the payment was declined and the card is now blocked so the thieving gits wont be getting a penny. We are going to contact the police, as we believe that an offence of attempting to obtain money by deception has taken place.

KEEP WELL CLEAR OF THIS COMPANY!!!!!!!!!!!!!!!
