Can my mother claim Council Tax Exemption?

Hi,

 

My mother is 82 years old and registered blind. She lived alone in her own home until 6 months ago. Her bedroom was upstairs, but the toilet was downstairs and the family felt it was dangerous for her to negotiate stairs in her condition.

Luckily a single floor wardened council flat became available nearby so she moved in.

We were required (by the council) to sell my mother’s original home and it was put on the market immediately. 6 months have gone by and the house is still not sold. Now my mother has received a bill for the Council Tax on her original house.

 

I have found the following clause under: -

The Council Tax (Exempt Dwellings) Order 1992

Class I:

an unoccupied dwelling which was previously the sole or main residence of a qualifying person who-

(a) has his sole or main residence in another place (not being a hospital, residential care home, nursing home, mental nursing home or hostel within the meaning of paragraphs 6, 7 or 8 of Schedule 1 to the Act) for the purpose of receiving personal care required by him by reason of old age, disablement, illness, past or present alcohol or drug dependence or past or present mental disorder; and

(b) has been a relevant absentee for the whole of the period since the dwelling last ceased to be his residence;

 

 

Would my mother qualify for an exemption under this clause in view of her “old age and disablement”
