      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I think I am a nice person. I used to work in direct customer service and became long term ill, I tried to stay at work untill a customer who couldnt get his way thumped me for not being able to stop his transport that had left without him and the panic attacks started. I lost my temper when he followed me to the office and told this first class passenger where to go. I got in trouble, no mention of the fact he hit me and I was trying to help him. He was first class of course;);) and I did try to explain the transport had gone. I ended up refered to hospital, mental as I was having a breakdown and my past became an issue once again due to the man wacking me. Things fell apart and my seizures were more noticeable, I couldnt hide them anymore. I must admit apparantly they didnt know such words could come out of a young mouth, but I think I was finally saying no, it not ok to hit me. Trouble is I was foul mouthed:eek:

 

Now I know in customer service of anykind we dont always hear what we want and its not the persons fault they rep the company or agency. But why is it nowadays people seem to delight in treating people like poop. It didnt used to be like that that I remember. Im really having trouble leaving the house amongst other things and these 'expletive' dont help me. Where have all the humans gone....I'm down

You rant away stardustjohn! This is a terrible way to be treated by your company. As for the "first class customer" what comes around, goes around- karma! Lets hope the next transport that goes without him takes his right hand off so he can't use it again!! Do I sound evil:D You will get loads of support on here so if you're feeling bad and have nowhere to turn- come here:)

After six months mental health help I went back but they followed me around like a hawk, regulary used to see the manager peering over the counter dividers at me, just in case:D

 

Trouble was I became paranoid and although they were later nice as soon as the word 'mental health' was mentioned I was a liability and felt it. Trouble was my workplace mates were like my family and when I left they obviously all got on with life and It was like a loss. To be fair if I had a seizure and needed a sleep they would let me go upstairs and lie down, but they even put me working with colleague counting every penny I held incase of mistake, so it became too much.

Health and safety was starting up then and they had to check for area I might land and bang head etc... my colleagues got fed up with it and did their best to swap shifts away from me, I dont blame them actually.

 

Thanks for interest by the way. Being put on anti depressants next week and stressed doccies lost blood test as theyre making sure they wont interact with epielpsy meds. So probably too much going on at once.
