Hi,

 

I know, I know .. stupid girl I am! But I have a number of PayDay Loans and it's spiralling out of control now, to the point I can't pay my rent this month.

 

I am putting together letters to each company with offered repayment schedules but can I stop them just carrying on taking payments from my Debit Card? If I write to them, giving them notice that these new payments are to take precedence over all previous payment arrangements is this enough to stop them taking unauthorised payments?

Hi scottteee.

 

Make the rent payment, that is the most important. Payday wont care if your tenancy is terminated as long as they get their money, it will probably make no difference at all your offering and what they take, they will want the agreed sum.

 

Lose your Debit Card and ring the bank now to tell them it has been lost and to make no further payments from it.

 

Make it clear in your letters that these are the 'maximum' payments you can make to them, include the first payment with the letter. No doubt you will get nasty letters, but keep up the payments you are offering and all will be well.

Little update for you. Too late to save some of my rent, but I can get back on track with that. I was having trouble with Poundstillpayday mainly. They have been ringing my mobile and my work place quite alot which has been fairly embarrassing as you can imagine. But thanks to people on here and their Posts, I put together a bloody good letter to them that seems to have done the trick for now, at least! They had left me messages saying they would call my work yesterday - and nothing! They haven't actually replied yet, though I have insisted on no phone calls. So I guess I'll just have to wait and see what happens next. But in the meantime .... thanks for all your help

Poundstillpayday have emailed me now saying they dont accept my offer and that they will send round Debt Collectors to my home. Can they do this when I have offered reasonable payments with my Incomings & Outgoings sheet showing what I can afford? What can these home debt collectors do exactly?

i can assure you they wont send around debt collectors

they will just sell it to a dca called clarity

ime talking from personel experience here

in the end, they were open to negotiate

 

tell the dca you will pay back the original ammount loaned but not the penalty charge

i believe mine was 70 quid

point being, penalty charges, by nature are unlawful

they have to justify every penny

70 quid for what

does it cost them 70 quid for a failed direct debit, etc

i think not

stick to your guns and they will drop the charge if you agree to pay back the original ammount

dont be intimidated though or show sign of weakness

 

i have yet to come accross a thread where a pay day loan company has taken some one to court

every thing about them is unlawful
