    • In terms of "why didn't I make a claim" - well, that has to be understood in the context of the long-standing legal battle and all its permuations with the shark. In essence there was a repo and probable fire sale of the leasehold property - which would have led to me initiating the complaint/ claim v SPF in summer 19. But there was no quick sale. And battle commenced and it ain't done yet 5y later. A potential sale morphed into trying to do a debt deal and then into a full blown battle heading to trial - based on the shark deliberately racking up costs just so the ceo can keep the property for himself.  Along the way they have launched claims in 4 different counties -v- me - trying to get a backdoor B. (Haven't yet succeeded) Simultaneously I got dragged into a contentious forfeiture claim and then into a lease extension debacle - both of which lasted 3y. (I have an association with the freeholders and handled all that legal stuff too) I had some (friend paid for) legal support to begin with.  But mostly I have handled every thing alone.  The sheer weight of all the different cases has been pretty overwhelming. And tedious.  I'm battling an aggressive financial shark that has investors giving them 00s of millions. They've employed teams of expensive lawyers and barristers. And also got juniors doing the boring menial tasks. And, of course, in text book style they've delayed issues on purpose and then sent 000's of docs to read at the 11th hour. Which I not only boringly did read,  but also simultaneously filed for ease of reference later - which has come in very handy in speeding up collating legal bundles and being able to find evidence quickly.  It's also how I found out the damning stuff I could use -v- them.  Bottom line - I haven't really had a moment to breath for 5y. I've had to write a statement recently. And asked a clinic for advice. One of the volunteers asked how I got into this situation.  Which prompted me to say it all started when I got bad advice from a broker. Which kick-started me in to thinking I really should look into making some kind of formal complaint -v- the broker.  Which is where I am now.  Extenuating circumstances as to why I'm complaining so late.  But hopefully still in time ??

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am wondering if there are any folks out ther who have just been dumped by their employers after years of loyal service who want a little pay back........are you :mad: .. do you want to go :p at your old bosses........ there must be quite a few and getting more each week who have been deemed 'not profitable' anymore....

Theres a few things I could say about a certain large credit card firm that I used to work for and a certain large high street bank I used to work for as well.... bit worried i might be cagbotted tho :D

Perhpas you would be interested in knowing I could look up anyone's account details and would've easily been able to casually jot these down and take it out of the building.

 

Also I would have been able to steal some cash on my last day which would've been extremely difficult to prove beyond reasonable doubt. Good job I'm such an honest chap (which is why I left BTW).

The question is how you measure, happiness. Is it with the people you work with, the people you serve, the policies and processes you deal with or because you have a job that pays the bills?

I suspect huge changes ahead as well within UK Banking as a whole.

I don't think the changes are a bad thing, even if the dreaded fees for a current account return people will be forced to (shock horror) actually THINK about thier current account. I know its a huge ask, but they'll have to shop around and discover how much they're getting ripped off.

 

The fact that HSBC promotes the 8% in credit interest rate on its bank account plus tells you exactly how sophisticated the average bank customer isn't when choosing an account. A casual glance at this account reveals anything you gain on the interest will be more than wiped out by the fees.

 

The overdraft is nothing to shout about as you can beat all of these features for free elsewhere.

 

The thing that amuses me is thinking about, if the banks do play the fees card, how they will handle the massive increase in complaints they get. People WILL complaint if they SEE what they are paying for something.

 

Thoroughly glad I'm to hell out of it.

It doesn't look like there are any other bank workers who will post unfortunately. Perhaps everyone is leaving because the game is up for the banks now. People tolerated the greed and excess when the banks threw money at them but those days seem to have gone. Now I think you will start to see everyone wanting their pound of flesh back. I think that the world is about to become a lot more competative and harder for those in the industry. When the bank of england says 'the good times are over ' I think they mean for both sides not just those hungry for credit.;)

Perhaps everyone is aware that to post adverse comments on their own institution CAN lead to disciplinary under the staff code of conduct if they are current bank staff.

You asked if anyone who worked for the bank wanted payback? Answer seems to be a resounding NO(quite a result for the Banks' would you not say?)

RBS Group are not making redundancies at all, and in point of fact have no plans to do so at branch/business level.

Credit crunch and bank employees being sacked? In the City maybe, but not the branches. We are firmly recruiting more staff. People may not necessarily want to work in a bank but the pay and overall package is, in my opinion, not tempting me to leave the RBS Group.

Pay, staff benefits and how they treat you within the Group. I don't see the good times being over tbh.

Even you will be amazed.

If you are not .......then I must agree you are the type of person RBS need, and agree you should stay put with them.

Nothing I read on a bank charges forums changes the way I think about RBS Group. It is about perspective. My own perspective has never been anything but constant on the forums. I have read the good, the bad and the ugly about NatWest/RBS Group and i remain in my view. Nothing will change that.

When my relative (the one I mentioned in the other thread, the one who had a nervous breakdown) worked for NatWest, he said to his wife that he was thinking of leaving to go and work for the local SUPERMARKET as the managers there earned more than he did!!!! And bear in mind that he was one of the youngest branch managers in the North of England. (in fact I beleive at one time he was the youngest)

 

I think your honesty and loyalty should be applauded. You wouldnt catch me talking that way about Abbey or Cap 1 who I worked for :D

Kind of contradict yourself there. staff can be disciplined for tell the truth about their employers but none of them want payback so thats a good result for the banks? Perhaps they are just scared. Doesn't sound very good for the banks that. Frightening their own employees and restricting their freedom of speech. Still what ever turns you on.....;)

Staff CAN be disciplined when they make comments on the internet. What if I was to say that Sir Fred Goodwin take a percentage of all monies taken as a result of bank charges only?(That is completely untrue, btw). Should a comment like that maybe made on facebook be allowed to remain without recourse? Is that threatening or is that something else? Perspective is everything in this. What you view as frightening employees is nonsense to be honest. Code of Conduct is something that is applicable to everyone from cashier to chief executive.

Also there are certain rules you have to follow with regard to confidential materials for example.

 

I was (rather stupidly) given info on coming changes in the way Natiowndie does some thing (not relevent to charges I hasten to add). I had signed a confidentiality agreement but wouldn't have objected if they had excluded me from the briefings because I was leaving.

I know of impending changes with NatWest NOT charges related but I won't post on any site REGARDLESS.

While you are working for the RBS Group or any bank you are under the confidentiality agreement while you work and while you dont because it relates to when you were under that agreement. It's a bit like being a nanny for Peter Andre and Jordan, you cannot release details to the press.
