    • Massive issues from Scottish Power I wonder if someone could advise next steps. Tennant moved out I changed the electric into my name I was out the country at the time so I hadn't been to the flat. During sign up process they tried to hijack my gas supply as well which I made it clear I didn't want duel fuel from them but they still went ahead with it. Phoned them up again. a few days later telling them to make sure they stopped it but they said too late ? had to get my current supplier to cancel it. Paid £50 online to ensure there was money covering standing charges etc eventually got to the flat no power. Phoned Scottish Power 40 minutes to get through they state I have a pay as you go meter and that they had set me up on a credit account so they need to send an engineer out which they will pass my details onto. Phone called from engineer asking questions , found out the float is vacant so not an emergency so I have to speak to Scottish Power again. Spoke with the original person from Scottish Power who admitted a mistake (I had told her it was vacant) and now states that it will take 4 weeks to get an appointment but if I want to raise a complaint they will contact me in 48 hours and it will be looked at quicker. Raised a complaint , complaints emailed me within 24 hours to say it will take 7 days till he speaks with me. All I want is power in the property would I be better switching over to EON who supply the gas surely they could sort it out quicker? One thing is for sure I will never bother with Scottish Power ever again.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello Everyone

 

Several Years ago I was naive and took out a loan from welcome finance with the misconception that is would help me pay off all of my debts. Big mistake. After loosing my job, charges started being applied. Harrassing phone calls letters and visits to my home started until I decided I had to move and change my numbers.

 

Now I am back on track, I phoned them up to continue paying off the loan to find out they have slapped £300 worth of charges on the account for calling me here and sending the odd letter there.

 

I have requested a breakdown of charges and a copy of my agreement verbally to which they have stated they will send me.

 

Is there anything I can do about this?

Hiya sfuk,

 

first thing is, did you take out payment protection insurance when you took the loan? Most folk did as they told us it was compulsary (yup, I got stung too!:smile:)

 

If you did then I would start by asking them why your insurance did not cover you. Wait until you get the agreement and list of charges then I'm sure the good folks on here can advise you on the next step.

 

You may not get this paperwork if you asked the branch though, may have to write to head office - the branches like to just ignore you when it suits them

When I lost my job, the guys at welcome asks me if i wished to rewrite the loan because I had fallen behind which I did. I did not take out ppi on the second loan.

 

I got my paperwork through but did not recieve the breakdown of charges.

 

What do I do now.

If you had PPI on the first loan then it should have covered you when you lost your job. Means you can start by claiming they missold you the 2nd loan. Buggers.

 

I was unsure how to start too but after reading what so many have done on here I would defo send the CCA letter asking for copies of your agreement and a full S.A.R. request which should give you ALL (maybe lol) info.

 

Then you can have a good pick through it and see where you want to start fighting them. saves you arguing endlessly with them, get your hands on your paperwork then see whats there. The good folks on here will help you no end!

Hello Everyone.

 

I am curently getting clobbered by welcome finance for stupidly high loan rate. Masses of charges and minimal replayments. I took out a loan with ppi sometime back and then lost my job. After telling me that my ppi did not cover the loan as my dismissal had been gross misconduct they agreed to rewrite the loan.

 

I am not paying for ppi on the second loan but believe I was paying it on the first loan. What do I do about both of these loans. Can someone help me.

Hi SF,

 

You can send them an SAR demanding statements for the a/c's and a copy of the credit agreements.

 

You can then set about reclaiming any charges made for late or missed payments.

 

If they cannot provide proper Credit Agreements, they must stop adding any charges and interest to the a/c's. They cannot Default you, nor can they sell the debt or pass it on to a DCA for collection. You would be able to repay the debt at a rate that suits you.

 

Re the PPI, if you were not covered because of the dismissal, that sounds reasonable (my opinion only) and at least they left off PPI on the new loan.

Hello Everyone

 

I am in the middle of disputing my loan with welcome finance so decided to send off a CCA letter and have recieved the relevant letters. A statement under the CCA. It also includes a statement of account. There are loads of differednt charges on this. Can anyone with welcome finance experiance throw any light on this???

It appears to be ok.......sorry

 

to be legally enforceable it must have

 

1 credit limit, amount of credit, or how the limit will be advised

2 Interest applied to the account

3 repayment schedule

4 your signature.

 

yours seems to have these

 

further it should lay out in a specific manner the way the agreement is made up, and the way the charges/costs/interest is applied, yours seems to do this

 

I would say it is ok (which is surprising for welcome accounts)
