      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i took out a loan with this lot which is naturally paid by DD, it shouldve ended last JUNE!!!!!! so need to stop that at once!

only thing is that i cant find my original agreement, i know there was definately PPI as they wouldnt allow the £8000 loan to go thru without it :confused:

payments are £228 over 5 yrs (or shouldve been!!)

how do i go about finding out the details of the loan not being able to get my hands on the documentation ?

anyone please :)

i know my paper work just isnt in order at all sorry :p

To get a copy of your credit agreement send them this legal request

 

Creditors and DCAs - Letter Templates & Budget Planner Send letter N with your £1 payment. There are statutory timelimits on this of 12working days + 2 postage, no ca they have breached the law and then after a further 30dys committed a criminal offence.

 

I would also send them a full SAR, you will find it in the ppi stickies.

Hello Honey,

 

If you do not have the loan agreements/reference no to hand

 

Send the S.A.R - (Subject Access Request) in the ppi sticky and add your details

 

Full S.A.R - (Subject Access Request) for ppi

 

Name

Address

DOB

 

Add a bit stating when the loan was taken out and the details of your NatWest account that the payments were taken from.

 

That should be sufficent for them to send you the details:D

think ive found away round the ref etc, i rang them today asking for a statement as i was looking to take out further agreement maybe in the future :rolleyes: theyll send me a statement, so should include all paid upuntil now aswell as ref number :)

im going to send the SAR monday morning as i cant tell a thing from these statements at all

the loan amount was £8000

the amount repayable is £13772.40

over 60 mths

ill let you all know how i get on and thankyou again for the help

If there is anything specific that you require in your S.A.R - (Subject Access Request).

Like, How much are tea bags these days?.:p

Do add it into your request.

They will only provide you with enough information to convince the courts that they are dealing with your request. When we know that they are just fobbing us off.

Dont be afraid to ask for anything that you need, better to do it now than waste weeks waiting for them to be helpful.:lol:

EEE TC your becoming a bit cynical in your old age, whatever is giving you that impression. Does Barclays and Natwest spring to mind:lol:

 

No joking apart, TC is correct, make sure you ask for absolutely everything the have on you. All information regarding the ppi and the interest that they apply to it. Any rebates given etc, telephone recordings if you took the loan out over the telephone, these are the things that you need.

 

If they come back and state that their databases don't have it:rolleyes: , if they made that calculation they should have it. ;-) You may need to keep at them.

 

When you SAR comes back and if you don't understand anything or are unsure come back to us:grin:
