Hi all,

Im new here and i have checked the FAQS but couldnt find anything similar to the dilemma i am facing. Here goes;

I am a student and i hold a student account with natwest. on the account i have an O/D which i have never been over the limit on.

I also have a student CC which i have failed to pay the minimum amount on a few times. I want to claim back the charges for these missed payments as i think that they will clear the current balance and i would not be able to clear it otherwise.

So there are 2 questions;

1. Are the charges for missing the payments penalty charges in the same way that late payment Fees are penalty charges, and are they just the same to claim back?

2. What is the worst thing that Natwest could do in retaliation to me being successful in claiming back these charges? Could they make me pay the whole of my O/D back? Or close/freeze my A/C. This is a large sum of money and i dont currently have the means to cover the amount that i owe them so if they chose to do this im B*ggered!

Thanks for any help.

Awesome forum BTW, good to see people standing up for themselves and winning for a change!

You can calim any charges which you consider to be disproportionate penalties.

Yes they can call in your overdraft

yes they can close your account

Open alternative accounts ! As a student you should be able to get some freebies from alternative banks. Personally I have transferred my business mostly to IF linked to my mortgage but I do have an MBA loan account with Natwest which might put a bit of a dent in my cc limits if they decided to close all my accounts.

Anybody think they might try closing ALL my accounts ? Or does it depend whether the person handling my refund is vindictive - having had an account with them for 22 years and paying vast amounts of interest they would have to cut off their nose etc ... I also do believe they have a customer value number so maybe paying up is cheaper in the long run.

There seems to be no common policy but be prepared for the worst

The law, in its majestic equality, forbids the rich as well as the poor to sleep under bridges, to beg in the streets, and to steal bread.
