I have been with RBOS since Oct 2003 but on 22 Feb 2005 I was granted my petition for bankruptcy the account I hold with RBOS is a basic account with no chequebook or overdraft. Will these cause problems with me claiming my charges back.I the time I have been with the bank I have had a total of £393 in unpaid direct debits although I have manage to get them to give most of the charges (a Goodwill Refund) through making a nuisance of myself there is still £158 still outstanding. How would I fill in my charges sheet?

Bankruptcy is not a problem although I expect that your creditors would want/be entitled to a share of the spoils.

I think that you might find that if you are still undischarged you are not allowed to issue proceedings in your own name.

 

It would usually be for the trustee in bankruptcy/Official Receiver to stand in your shoes.

 

I would check this first to make sure you dont get into difficulty with your trustee.
