My question there is really what might constitute proof? Since you say the issue of delivery is a common one I suppose that no satisfactory answer has been established or you would probably have told me.
    • I would stand your ground and go for the interest. Even if the interest is not awarded you will get the judgement and the worst that might happen is that you won't get your claim fee.  However, it is almost inevitable that you will get the interest.  It is correct that it is at the discretion of the judge but the discretion is almost always exercised in favour of the claimant in these cases.  I think you should stand your ground and don't give even the slightest penny away Another judgement against them on this issue would be very bad for them and they would be really stupid to risk it but if they did, it would cost them far more than the interest they are trying to save which they will most likely have to pay anyway
    • Yep, true to form, they are happy to just save a couple of quid... They invariably lose in court, so to them, that's a win. 😅
    • Your concern regarding the 14 days delivery is a common one. Not been on the forum that long, but I don't think the following thought has ever been challenged. My view is that they should have proof of when it was posted, not when they "issued", or printed it. Of course, they would never show any proof of postage, unless it went to court. Private parking companies are simply after money, and will just keep sending ever more threatening letters to intimidate you into paying up. It's not been mentioned yet, but DO NOT APPEAL! You could inadvertently give up useful legal protection and they will refuse any appeal, because they're just after the cash...  
    • The sign says "Parking conditions apply 24/7". Mind you, that's after a huge wall of text. The whole thing is massively confusing.  Goodness knows what you're meant to do if you spend only a fiver in Iceland or you stay a few minutes over the hour there.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Have sent polite reminder by recorded mail today to let them know the 14 days has lapsed and my moneyclaim will be entered online on Saturday. That basically gives them from receiving my letter tomorrow morning until return post on Saturday to issue that cheque otherwise they will be paying the interest and the court charges......and anything else I incur.

 

I presume their tactic is to hope people don't go through with the claim and bottle it. Hey ho, now it's going to cost them more.

I presume if they made you an offer already, thats as far as it goes for that department? I was made an offer earlier this week and told it would be in the post to me...it hasn't arrived and I've given them what will be an extra two weeks by the time I file with moneyclaim. And they seemed so efficient compared to other companies.......:roll:

Haven't been made an offer. They just went quiet after the LBA was issued. Got a letter to say the claim was escalated and then silence....

 

I wonder if it's because I am no longer a customer although they should be thinking 'hang on, this guy has nothing to worry about with going to court' ie no account to close, no way to harrass me.

 

Claim being filed tomorrow (wonder if they really do look at this site). Will keep you updated. Got a reply from MBNA today but my wife's gone out so I can't get her to read it down phone!

Hi, just wanted to let you know.....

It all went quiet with them for me too after the LBA. They phoned and made a further offer on Monday this week which was three weeks after I sent my LBA. So filing with moneyclaim was a week overdue. Just received a cheque today for the full amount requested in full & final settlement. Thought you might like to know:D

Any news from MBNA, I will be on with soon and like you with this one my account has been closed for some time.

Filling out my Amex moneyclaim now as I think if I don't follow through with my timetable they may take me a little less seriously.

 

MBNA sent the bog standard 'get back to witihin 28 days....', well tough, you're getting 14 days and that's that! :)

 

I even put a paragraph in my Prelim saying 'don't waste my time or yours with a standard letter' guess they don't care about chopping trees down to create waste paper.

Claim deemed served on 9th July so does that mean I can go for a judgement on 23rd? 14 days after serving?

 

Technically, it will be the day after as there has to be a full 14 days. That is, if they don't defend it.

Please note that I am not a legal expert and all advice given is without prejudice and is purely my opinion only.

Thanks. I expect them to defend to drag it out longer. If they worked out the cost of defending the action (their time & expense) and the extra costs they will pay me (interest, court fees) it beggars belief they don't settle earlier for such a piddly (to them) amount.

Firstly, apologies for starting that other thread. I realise now why I should keep everything together and will not be a bad boy again. Maybe a Mod could merge? Please?

 

Now, up to date. As mentioned (in other thread) the date has come for a default judgment and Amex have neither acknowledged the claim being served or defended it.

 

They have however sent me a cheque for £54 which is in full and final settlement. Erm, guys my court fees were £30!

 

I have just visited the moneyclaim site and clicked on judgment (been eyeing it every day since the claim went in) and was told happily I could request a judgment at this time.

 

Minused the £54 from the total and requested the rest to be paid immediately.

It now goes to final check tomorrow and hopefully is then sent off to Amex for the rest.

 

Cannot believe they thought they could just ignore the claim and send me some 'go away money'.

The judgment was accepted and issued today and sent to defendant. There is now a new option on Moneyclaim for 'warrant'. Do I click this? or just wait for Amex to reply to the judgment? Anyone else got through the claim process online to this point please help.

Received a letter from Northampton (courts) stating they had indeed sent the judgment to Amex. How long out of politeness should I give them before I issue a warrant and send in the Bailiffs?

 

Obviously I don't really want to do this (honest) but I am a little surprised at Amex's slow response. They would have received the judgment a few days ago and I have had nothing back. Then again maybe my patience isn't what it used to be!

Have sent a letter to Carole White (if you are watching) asking for the rest of my money otherwise I wil be issuing a warrant of execution. Which they will have to reimburse me for too.

 

If it goes that far I will let everyone know when the bailiffs are going in and we can go watch :lol:

You are so patient. Send that execution button. They will have the added bailifs costs for being incompetent. However did you go for removal of default too?

Warrant of Execution against American Express requested.

It took a while due to lack of funds but today it was done.

I shall be watching moneyclaim intently to see if it is issued and then what Amex do. I partly hope I get the cheque through post and partl hope the bailiffs go in and remove the pot plants to sell and the Brighton Reporter (or whoever) reports it all.

 

Word to anyone chasing Amex. They are incredibly efficient at replying to preliminary letters and DPA requests and then they shut up shop. Be prepared to go the whole way. This claim was over an initial £102.

 

Next target is MS who defaulted on the CCA request today. Should be fun.

Hi, yesterday my Warrant of Execution was issued and is being sent to the appropriate court for the Bailiff to action. So unless Amex get a stay of execution (I think) the bailiffs will be knocking on their door.

Had absolutely no problems with Amex refunding all the fees using standard forms from this website. They were first to respond to my data access request and first to refund the money. Meanwhile MBNA responded in most peculiar way to my ROC, they replied straight away with "We don't agree with watchdog decision blah, blah as a good will gesture we put £100 to one of your accounts". Say what? I didn't request any money yet, I just wanted to see my statements, how much do they owe me that they got so nervous so fast. :eek:

I believe MBNA have started to do that as standard when people ask for 6 years statements. Amex were super efficient at first but then went extremely quiet. I think it is because I don't have an account with them anymore or maybe they just overlooked my initial application to the court and got defaulted by mistake.

Ok, so it's the 23rd August and no word from Brighton as to what has happened. Don't mean to sound impatient but anyone got any idea how long it takes for the bailiffs to visit after a warrant is sent? It was issued on the 14th.....probably am being impatient aren't I? :)

hi i got to the final warning stage before court action, but i got wrapped up with work and trying to get barclays. any way out of the blue i got a geasutre of goodwill cheque in the post with all the interest up to when the letter they sent with the cheque was sent. which i thought was aufully nice of them.

Keep going guys you'll get results

Thanks Ombler. Just read your other Amex thread. Nightmare! Well, I got a reply from Amex on the 25th August (dated 21st August) regarding my warning to seek a Warrant of Execution dated 1st.......they obviously take the Courts seriously then. It states that if I send the court papers to them they will consider my request. Warrant was issued on the 14th and apparently takes a couple of weeks to action so I expect the bailiffs will be at their front door before I could reply. I'm happy to let them do the work now. Might get in touch with the Brighton Argus....... :)
