I started my claim a long time ago last year and then I read lots on this site. However I am a bit rusty now and would like some info. please. My claim is against RBS for a total of 7087.05.

1506.76 being charges, 5330.29 being contractual interest and 250 court fee as I completed MCOL 30/03.

Some months ago I received an offer of 1807.35 from Cobbetts on behalf of RBS. I cashed this cheque and spoke to the court as they(Cobbetts) were asking me to sign a notice of discontinuance stating that my claim for interest would be unsuccessful anyway. Courts stated that it was my choice but that unless I was going to discontinue my claim that they did not require anything from me.

I have received a letter from the court dated 3/10 which encloses a pre-trial checklist(how do I complete this??) and adds that there is a listing fee of £100 and a hearing fee of £500. But I have already paid the MCOL fee 0f £250???

Cobbetts have sent me a letter stating that they will write to the court seeking an order that the rest of the claim be dismissed.

When do I prepare the cort bundle and when is it sent to the court?

Will I have to pay the additional £600

Help I'm in a right pickle and as I am planning to get married next year I can do without shelling out £600 which I have not got

cherminate, if you're pursuing this claim purely for the contractual interest only, it may be wise to discontinue with the claim at this point. If you're received your charges in full it's doubtful that you could be successful attempting to reclaim the contractual interest at this stage.

 

A claim was lost this year (precedent setting case) and the advice on CAG is not to pursue contractual interest on bank charges claims unless you're 100% knowledgeable on the subject.
