I have just completed 6 months with a small company and have been sacked for poor performance, basically I was employed as a senior projects specialist with a sales target, the company director promised all sorts of rewards and help providing leads, over the past three months I have been asked to carry out installations as part of my job which took me away from sales and hence I didnt meet some of my targets, on completing a large installation he called me in the office and simply said you havent met your targets your out and placed me on garden leave, I had no disciplinary hearing at all, I was called in by email at 6.30pm on a friday night for a monday morning meeting...

 

I am still on garden leave, however I am aware of emails and phone calls he has made to customers and contacts alike basically slagging me off, these are contacts i was hoping to approach for a job.

 

do I have any recorse here?

How did you become aware that he is contacting the customers/contacts. Do you have any documentary evidence?

I am privy to an email that has been sent out, basically saying although they mean me no harm, I was not any good at this and that, I would hate to have to use this email as it was forwarded to me by a friend, I am at a loss i think

I would be looking to speak to a solicitor on the basis of potentially libelous statements which your employers (ex) have made.

 

there is an Act of Parliament called the Defamation Act 1996 and it would appear what has been done is in breach of the said act, based upon what you have said. you would need the proof from this email to substantiate such claims and to be honest it is something that a solicitor would need to consider to confirm if there is sufficient information/evidence to make such a claim

 

many solicitors offer a 30 min free consultation so it wont cost to find out
