Hi everyone, I currently work shifts(4 Days On & 4 Days off) 12 hour days. I have been told that my hourly rate is worked out a year in advance by working out how many of each day of the week I work in the year and what I would the hourly rates i.e time & half for saturday and double for sunday etc. Is there any way I can get my employer to disclose these workings.

 

I left my last job 4 years ago(Monday to friday hours) for a 80% pay increase but now a friend who still works for my last employer is about to overtake my hourly rate.

 

Any advice would be big help.

It looks like you are on an annualised hours contract ?

 

Whatever, you have the right to see how they calculate hours/days that you haven't worket yet. Was there anything in your contract of employment that explained how this was calculated?

Thanks, it just states the hourly rate.Also If a bank holiday falls on my day to work I just get paid the same rate, if i want it off I have to take a days holiday and even though we are only closed christmas day, boxing day and new years day if any of them fall on my days to work I have to take a days holiday.

The government has made legislation as regards to public holidays. They haven't said that you can have bank holidays off, but from October 2007, workers are entitled to 24 days paid leave and from April 2009 to 28 days paid leave.

 

This is to include bank holidays.

Conniff is correct.

 

Bank holidays are just that. Legislation determines that banks must be closed on these days but nobody else is required to do so.

 

Therefore your employer is well within their rights to make you work any bank holiday, pay you single rate as any other day and include it as part of your annual leave.

110 % correct in this day of 24/7 shopping many many more people are contracted to work for single rate pay on bank holidays.
