    • Please provide advice on the following situation: I rented out my property to four students for 16 months until March 2024. Initially, the property was in very good condition, but now it needs extensive renovation. This includes redoing the bathroom, replacing the kitchen, removing wallpaper, and redecorating due to significant mold growth. The tenants also left their furniture on the grass, which is owned by the local authority. As a landlord, I've met all legal requirements. It seems the damage was caused by poor ventilation—windows were always closed, and heating wasn't used. There was also a bathroom leak fixed by reapplying silicone. I tried to claim insurance, but it was denied, citing tenant behavior as the cause by looking at the photos, which isn't covered. The deposit barely covers the repair costs, or else I'll have to pursue money claims, which I've never done before and am unsure about its legal complications or costs. Any thoughts on this?
    • The part in question was bought direct from Hotpoint (to replace a burnt door interlock and melted wiring). I'm unsure of the original retailer the machine was bought from, we're talking 5 years+ ago, but I can find out if absolutely necessary. It's one of the models that was listed on the recall list, but Hotpoint have stated for many years it wasn't an affected unit when given the serial number - I expect this is why they offered a FoC engineer visit because I sent them pictures of the (new ) burned door interlock.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just thought would let you know, may be useful for other Halifax credit card holders who supposedly signed up for PPI over the phone. I have been going through the formal complaint process with Halifax, after being charged for PPI for the last 4 years without my knowledge, and after I cancelled. After the complaint, Halifax stated that they could not find any transcript of the phone call, and so had no proof that I had ever signed up for the PPI. They have agreed to give me a full refund of all premiums, plus interest! Oh, and they also accepted that I was missold the policy as I was not working at the time.

Think the most important thing I learned to pass on, is that with credit card PPI, the PPI is often sold seperately to the initial contract, and often over the telephone. With this in mind, unless they have kept a transcript of the conversation(unlikely) or you signed a document and they kept it(also unlikely), it is fairly easy to challenge a credit card PPI on the basis that they cannot prove you ever took it out - it was certainly the avenue I concentrated on, and it paid off :)

Spoke too soon.

 

Received a letter from them today, stating that I had had credited £114.83 in premium costs(sounds about right) and £9.19 in interest!!! Over four years, this is derisory. Not only does each PPI premium need compound interest applying to it at the 18% or 24% Halifax have been charging, the TOTAL of all that needs 8% statutory interest as well! Plus, they have yet to credit me for the £60-80 worth of penalty charges brought about by the PPI cover.

 

Back to the drawing board!!!

Just to confirm, am I correct in thinking that as they have not put in writing anything about full and final settlement, I can accept this money so far without jeapordising a continued claim for more interest and penalty charges?

If they paid, than write to them..confirmin that you accept the sum as a partial refund ONLY, and add the extra claiming ammount you wanted to add...

I actually have a contact there with phone number, so I will ring them in the first instance.

 

Can I run by you what my complete claim is in effect?

 

They have now accepted in writing that:

a) they have no evidence whatsoever to suggest I ever signed up to the policy.

b) if I did in fact take out the policy, I was ineligible and therefore mis-sold it.

 

I may have lost this letter :S but I will cross that bridge when I come to it - assume I have it!!

 

Therefore, I believe I am right in having the opinion that I am entitled to be in the same position, both financially and otherwise, that I was in prior to them wrongfully charging me.

 

Therefore, I am after:

 

- Full refund of all PPI payments over 4 years(this is all since August 2003).

- Full interest incurred by these PPI payments. By this, I again assume I am correct in believing this interest should be the actual compound interest incurred on the card for each single PPI payment? And at the interest rate at the time? So therefore the September 2003 payment should be compound interest for the whole four years? At the variable rate that the card was at? As this is my actual financial loss.

- Due to the payments, and lack of knowledge of the payments, my minimum payment was not in fact covering the increase on the card each month. Eventually, I went over the credit limit, for around 6 months, and incurred charges each month. This is clearly due to the fact that the PPI was wrongfully taken. Am I entitled to this back and associated interest?

- As per the above, am I right in assuming I am entitled to have my credit file defaults removed?

 

I think that was it!!

YOU are totaly right.

 

 

I normally put all the figures in the spreadsheet, charges, PPI, interest, cash withdraw fees, monthly interest and contractual on the top+ £10 for S.A.R - (Subject Access Request), 6.35 for each letter + 1.12 recorded stamp+ 9.65 per hour spent on claim.

 

If they do not have a prove you wanted PPI, they shouldn't had charged you at the beggining and if those charges made you ODed, than you should add those charges as well( but they should be in your spready anyways!!!..all the charges)

OK.

 

Well, he was fairly defensive - insisted that it was a final settlement, and nothing could be done. Then by the end of the conversation he said he would see what he could do :)

 

3 quick questions:

 

1) If the letter detailing the amount repaid so far does not state full and final settlement, can they later say that it is and it be valid? Either verbally or in writing?

2) Stupid question this, but I assume I cant claim back both the interest on the credit card (18% and 24%) AND the 8% statutory?

3) Does anyone know of(or, does anyone feel nice enough and good enough in excel) a spreadsheet that compounds the interest on these charges? The only spreadsheets I can find here do not compound the interest.

- Divide the "Estimated interest" by "closing balance" to calculated the monthly interest rate each month.

 

- Multiply the PPI charge by ("monthly interest rate"/100) of the month after, to get the first interest on it. Then multiply this result by the next month etc etc to get the compound interest.

 

- Do this for all the PPI charges.

 

Does this sound right? Do I need to take into account what was paid off etc? Even though it was only minimum payments each time?

I do, I'm just trying to establish the best way of working out the interest I was charged, and am wondering if the amount(minimum) I paid each month will affect it in any way?

I am not an expert with the working of calculations, but that sound about right.:D Do you have the terms and conditions of the policy or anything to go on, such as ?? % of the balance, So many pence re £00 of balance. I am sure they will correct you if you are wrong.:eek:

If you paid your min amount only, than your monthly interest would be high...But you are going to put your monthly interest in the spreadsheet so it will be added to the claiming total......

Congratulations! I am in the middle of trying to reclaim from them myself and have only today received the knockback letter (with a copy of a CCA which is amazingly not in my handwriting!).

 

Think I'll take motivation from your case and get torn in!
