There are no guarantees of course, but when it comes to put or shut up they definitely tend towards shut up.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

2 1/2 years ago we got a car through welcome car finance and we did actually get a pretty good deal , anyway back in september we decided to upgrade and trade in our car for something newer , we had paid over half of our oringinal agreement and there was less than £4000 owing the car we traded in was still worth £2500 if not more and he took this as deposit and then there was around £1000 left outstanding on our agreement which was added to our new agreement, the car we got was quite a bit more a month than our previous one but we thought we would be fine , anyway last month we started to struggle with payments and we also had a loan with these **** bags aswell i was about to write to ask if we could lower our payments for a couple of months when i recieved a phone call from a lass at welcome, i explaind we were having a few problems and she suggested that we could combine the loan and the car into one payment making the car ours stupidly i agreed as we were desperate at the time. Anyway we decided to sell the car which turned out to be worth £3000 less than what we ended up paying for it i didnt realise how much we had payed for it untill i looked at the documents properly also we never got anything back on our old car , and now the loan we have with them is nearly as much as our morgage .it is still less than the loan and car was but its over longer .Non of their paper work makes sense we have been totally robbed by these swines and there is nothing we can do! (or is there)

they are the **** of the earth, there staff are pig ignorant all nice and friendly when ur signing the forms as soon as u miss a payment etc there like flys round s***. refuse to speak to them over the phone as they say one thing and do another.

we have a secured loan with these prats and we have fallen behind with payments , the other week one of their people rang to ask if i was making a payment and i tried to stall her by saying that hubby hadnt been paid (as his wage was low this month due to being off sick), she hung up and rang back a few minutes later saying she had rung my husbands employer and they had said he had been paid, are they allowed to do this? plus they ring me all the time they ring my husband at work they are awful people to deal with.is there any where i can complain about them surley they are not allowed to ring his employer to find out wether he has been paid

No they are not allowed to ring his employer and I doubt very much if they did - even if they had the employer wouldn't give out that sort of information. They more than likely just used this to frighten you in to thinking they are God.

It is important that you keep your priority debts up to date - are you struggling with others or is this just a temporary glitch?

Make an offer to catch up the arrears over the next few months.

As this is a secured loan it is a priority debt and you must pay it or at the very least keep the lender informed about your situation and make an offer to get back up to date over a set period of time.

 

Do you have other debts that are unsecured such as credit cards? These are non priority debts and these should be paid with what you have left over after paying the mortgage, secured loan and household bills.

they have actually agreed to reduce the payments for us, but we have another secured loan aswell.we are behind with our morgage but are aiming to clear this within the next couple of months.

what we dont understand is how they managed to secure the loan on our property, we already had a secured loan and was only able to get a certain amount with the loan due to the equity in the property, if we were to sell our house now it wouldnt cover everything as the morgage has an early repayment charge

we had a car through welcome and a small loan and as we were struggling with payments they comined the two so the car became ours and we could sell it and we hoped that from the sale of the car we could get a cheaper car and and pay a lump off the loan , when we came to sell the car which we had only had 6 months we lost nearly 5000 grand on it as it wasnt worth no where near what they had originally valued it at. i said at the time to the woman that we were dealing with how were they going to secure it on the property when there wasnt the equity really in the property she was very vague and said there was ways round it we were that desperate at the time i think that much about it, stupid i know but i just cant get over their bully boy tactics.

There doesnt have to be equity to secure the debt as they work on the assumption that property prices will rise thus giving more equity.

I think you need to find out how they got this secured - or was the small loan originally secured and you agreed for the total to be transferred to that loan? Can you remember or do you actually have copies of waht you signed?

Iwould suggest an SAR to welcome to see what the yhave and check with the land registry what they have registered there.

Have you checked with land registry, online it cost's £2 to check yourself. You can see if it is secured or not. Mine wasn't!?!?!

 

Be very careful about reduced payments, these will add even more to the debt as WFS post their interest monthly, it seems based on the previous months balance, my payments were £163, yet monthly posting was £127.

 

Have you done a Consumer Credit Agreement request? This can highlight some interesting things, it only cost's £1 - the templates are around.

we have a welcome secured loan (unfortunatley) it was taken out last year basically we had a car and a small personal loan with them and started to struggle with the payments, their suggestion to help us out was that they turned the personal loan and the car loan into one loan so that the car became ours and if we wanted we could sell it. we agreed and went in to fill out the papers there was no mention of the loan being secured if there was i dont remember it, the whole thing only took about a week, as for the loan amount i still to this day dont understand the figures we had only had the car about 6 months, at the moment we owe about £17500 the purchase price of the car was £7500 and our personal loan was for £2000 and they gave us an extra £1500 to pay off a couple of bills, now at first the amount was a lot higher but we struggled with the payments so they did something with the loan which halved our payments and froze the interest on it how i dont know but when we went in to do the paper work the second time round we didnt fill anything out she just had us sign a few things and said she would fill the rest out later, we have struggled a little with the payments , they have rung numerous times called at the house rung my husbands employer to check wether he has been paid, the are awful people to deal with , is there anyway i can complain about this + id still like to know how they managed to secure the loan on our property when there was no equity and i also thought they had to have permission from the morgage company

Hi there, I bet the rest of that figure is PPI they stick it on everything whether you want it or not - do you have any paperwork at all relating to the loans?

Hello,

 

I took out a secured loan from welcome early last year for about 12,100. I had struggled with payments and I was in mortgage arrears and close to a repossession hearing. Welcome "kindly" offered to extend the secured loan so that I can pay off the mortgage arrears and thereby stopping any repossessions. I was at their office in Sutton and signed the forms for a 26k loan. This covered the previous loan and paid the arrears and left us 4k to pay off other stuff. I was shocked when they gave me the monthly repayment figure of 449.50. I have to now keep to this arrangement for 6 months when they said that they will reduce the figure to about 350. However after reading this thread I believe that PPI is responsible for the high repayment. Am I in any position to request that this PPI be taken out, or do I have to wait after the 6 months are up?

I think what they have done here is calculate the interest at the beginning of the loan and add it on as a fixed lump sum to the total amount of the loan.

 

For example if you had a loan of £10k, with a 20% APR over say 10 years.

it would calculate what this would be equivalent to (in this example the interest would be over £11k) and adds it to the loan at the beginning.

(In this example the £10k loan jumps to £21k)

 

Plus as Ell-en said you may have payment insurance on top.

i have a so called secured loan with these idiots, it all started when we originally got a car on finance we had it for 2 years then traded it in for a newer one, we also had a small personal loan with them aswell, we got into difficulty with payments with the car so they offered to turn the car finance into a loan and combine it with the personal loan so we could sell the car which stupidly we agreed to, this loan turned out to be a secured one the thing that puzzles us is

1. we already had our morgage and a secured loan, i pointed out to them that they wouldnt be able to secure the loan as we didnt have enough equity and also when we got our first secured loan we were told we could only borrow a certain amount as our morgage company wouldnt allow them to secure anymore on the house, we were told that this wasnt a problem

2. it was all settled within a week i thought there was supposed to be a 14 day cooling off period

 

since then we have had problems with the payments they have reduced the payments twice, we have had constant phone calls sometimes up to 8 a day in the end we ignored the phone, they would call my husband at work they even asked his boss if he had been paid, they have turned up on the doorstep numerous times without informing us beforehand, just recently its all gone quiet dont know how long for though,

i recently spoke to someone at the cab who has made me an appointment as they think there is something dodgy about this loan and want to look at it further

i am going to dig out all the agreements and paperwork we have from them and see what i can find after reading the large welcome thread it makes very interesting reading

im also going to look at the car finance agreement because our first one was taken out in 2004 and we had all the extra insurances from what i can remember also we had ppi on the secured loan in the beginning but they removed this when they offered to reduce our payments, they have since offered to reduce our payments again but we havent had anything in writing , the first time they sent a new agreement i think , its all very confusing ill have to dig out my documents , we are way behind with our payments but we have never recieved a default notice which i find strange
