I bought a car through yes car credit. I got behind on the payments and my car was repossessd, they said I still had to pay £3000 which im paying through thames credit. I am paying £35 a month because im on benefits. I recently had to go to court over a debt and the judge told me I do not have to pay the debt because Im on benefits. Does anyone know if this is true? Im happy for any advice

Well if the judge said it I guess it must be.

 

Was the £35 agreed through the courts or just what they bullied you into paying? Are they still charging interest?

At £35 a month it would take over 7 years to pay off the balance. If they are still charging interest as well at whatever ridiculous rate they have then it will be considerably longer than 7 years... people have got shorter sentances for murder!!!

 

Get down to your local citizens advice and see what they have to say about. I can't even see why you still have £3000 to pay even though they have taken back their goods.... how much had you paid off the agreement before they took the car back?

Have you done a search through the forums? Your question might already have been answered by someone more knoweldgable than me who has been there and done it.

 

I presume they got the court order to reposess as you had paid over a third?

yes they did, two heavies turned up and said if I dont hand the keys over they would break into the car and I would have to pay for the damages.

And your sure they had a court order? If not then they have to return all monies paid.

where was the car parked? on your drive or on the road?

If the car was parked on your drive and you had paid over one third then they should have had a court order to remove your car. However if you handed over the keys to them then they will say they had your permission to take the car and ofcourse will deny threatening to break in. What time did they come to the door? They are not allowed to come to your door after 9pm.

 

If however the two collectors placed you in a state of fear and alarm and in anyway threatened you or made you feel threatened to hand over the keys then you have a good case for not paying. You would have to be able to corroberate this, perhaps you had a witness in the house at the time? Afriend who overheard the conversation?

Yes Car Credit charge for interest up front on all their contracts. That means you should not be charged interest for any outstanding debt.

 

My advice to you is go and see your local CAb and ask to speak to one of their specialist advisors regarding YCC. There are a number of legal arguments against a YCC contract that are making there way around the law courts. These arguments are causing the chasing debt collection agencies to set aside the debts. Thats is making the debt unenforceable. Although not officially unenforceable it is highly likely they will NOT become enforceable.

 

They are still charging interest, it wasnt agreed with the court it was thames.
