Hi guys,

 

I'm new here but having a read through the threads it looks like the place to be, and I hope some of you knowledgable folks can advise me!

 

Here's my situation so far. I've sent the pre-letter with no response. Filed claim with moneyclaimonline. Now this was rejected with the bank filing a defence.

 

Today I have received around 10 pages from their solicitors. Firstly an 8 page defence which basically states that I haven't provided enough detail about the charges and therefore they cannot defend the claim properly.

 

The last few pages are the request for further info. It states that I am asked to provide a response 'in accordance with CPR Part 18 by 20th August'.

 

'The request' reads as follows:

 

1. I your claim you state: "the Defendant...has applied charges to the Claimant account".

 

2. Please provide the following particulars in support of your claim:

 

2.1 In relation to each charge please identify (a) the date when the charge was charged; (b) the amount of the same; and © the reason(s) given for the charging of the same

 

2.2 In relation to each charge, please clarify the following: (a) is it the case of the claimant the same should not have been charged? (b) If yes; please explain why the claimant contends that the same should not have been charged? © If no; is it the case of the claimant that the same should not have been charged in this amount? (d) If yes; please explain why the claimant contends that the same should not have been charged in this amount and identify the sum the claimant should have been charged. (e) If no; please state the claimant's case.

 

 

This has come directly from the solicitors and as yet I have not received anything from the courts itself. I have statements for the charges and also letters from the bank re: 'Paid referral charges' so can provide those details easily. So my questions are these:

 

(a) Firstly, as this is all from the bank, do I have to follow their set deadlines?

(b) In relation to part 2 of the request: How much of this requested info do I really need to provide and in how much detail? I'm assuming this is somewhat of a delay tactic on the bank's part, so do I need to put a whole lot of work into answering their questions or will the simple fact that I respond be enough?

 

Any help with these questions or any other advice on what to do from here will be greatly appreciated... My claim is very small but I'm damned if I'm got to stop now :)
