      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

 

I have decided to reclaim my charges from my RBS Mastercard. It isnt for that much probably about £150 if that, but the chages did cause me to go over my limit and because of that I have a default which i am going to hopefully be able to get removed.

 

I have a couple questions which i hope some one will answer,

 

I know for bank charges you send to your local branch but in this case do i send it to the address in Milton Keynes? or because it is with a DCA (Triton), should i send it to them?

 

I have a bank account with them too but because of a rather large overdraft im not claiming for that just yet, but because im claiming from the RBS Mastercard will they close this down?

 

I am quite scared of going to court as at present I have no idea what to do, but I will try, and im sure I will get them back with all the help i will (hopefully get here)

I think you might be surprised - most people who estimate how much they might get back tend to find there are much more charges than they thought!

 

There should be an address listed in the sticky posts at the top of the RBS forums. Otherwise just send to their Customer Relations Team (should be easy to find on RBS website).

 

They cannot touch your bank account because you are going after your credit card however, the Ombudsman would be very keen to hear from you if they made any retaliatory action towards your overdraft if you went for your bank account charges (because they can't do that). Something to consider.

 

As for being scared - be assured that pretty much everyone here was in your boat at one time and with the help and support of those around you (and a bit of research from yourself) you will be a pro in no time.

 

Spend some time looking through the RBS successes and also the Library forum - there are plenty of FAQs, guides and template letters available in that area that should help you enormously.

Hi, well i obviously havent received my s.a.r. but I have by chance uncovered all my credit card statements. Bearing in mind I was unemployed when they granted me a credit card in July 05 with a £250 credit limit which I never started to use it until Jan 06. My balance now is £370 or thereabouts.

 

Anyway I have calculated, that my unfair charges come to £196. I am not sure how to proceed with this. I have noted other people have asked for the interest they have been charged back too. Do i do this? and if so how?

 

Hmm, I guess i should wait until i receive my full s.a.r. so i can claim all at once? and i would like it all to go towards paying this credit card off? they are unlikely to send me a cheque are they?

well today i checked my online banking and they have not cashed the s.a.r. fee but have charged me a single £5 historic statement fee! Whats that all about? Has any one else had expierience of this?

They have done this from time to time, this is the fee they charge for producing statements. I have seen others be charged this in the past. The two scenarios I've seen in the past were:

 

They say "you don't need to pay 10 pounds for and SAR, you can just get your statements this way". The problem with this is that if anything goes wrong with the statements you requested you can't threaten them with legal action because your request wasn't an SAR.

 

They charge you the 5quid AND bank the cheque. Well they're taking the mick there aren't they.

 

 

I would correct them on this for one important reason, if they don't give you all your statements you will find it a lot harder to correct things if thye haven't followed the the process for an SAR. If you are comfortable on the phone, I'd ring them up and tell them that you have been charged a fee and don't know why and tell them straight that your request MUST be treated as an SAR not as a simple statement request. Insist that the fee is refunded and your cheque banked. If not, do the same via a letter.

hi all, well i composed a letter over the weekend and had the intention of psoting it yesterday. But omg! the statements have arrived, but thats it, just the statements, and even then they are only from Jan 2005!

 

I swear, these banks should know what to put in these s.a.r.'s. Im totally upset they have done it this way!

hi, well I sent my s.a.r. to my local branch as I decided to get my bank account details too.

 

I have now received all of my statements twice over in 5 different packages, one of the envelopes had ripped too!
