    • Perfect, thanks Dave.   You're right, a whole dodo storm this has been. As sons of first-generation immigrant parents, whenever something like this happens the old man panics. There was a whole "appeal this now" because my dad paid for the parking as he was with the hirer at the time and he isn't as tech-savvy as my brother so he ended up doing what he did and because I don't live there anymore it came all the way down to this.  But yes, we'll do this SAR and see what comes of it.  Will keep posting here with the hopes that it may benefit someone in the future.  Thanks again, everyone.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

I am new to the site and hope someone out there can help. I was having charge upon charge added to my current account with the Ulster Bank ans was forever disputing them. I decided to open a new account with another bank and brought my Ulster Bank account under its £250 overdraft and was going to pay it off then close the account. Ulster Bank then proceeded to add more charges to the account and I refused to pay them. My account balance rose to -£500 due to these charges.:Cry: After speaking to the debt management dept in the bank they have now removed these charges and I am paying off the overdraft of £250.:-)

The problem I now have is after checking credit expert Ulster Bank have added a default to my file. What should my next step be to have this removed as it is severley affecting my ability to get credit.

 

 

15th December 2009 UPDATE

 

As I have had no replies from u guys i assume u r thinking search the site and you will find all you need ! As I am not the most eloquent All I was hoping for is an example of a initial complaint letter to send to my bank stating that since the amount was in dispute that they were breaching the Banking Code. PLEASE HELP IF YOU CAN I WILL APPRECIATE IT.

Had a call from recoverys clerk who informed there was no notes on my file to say that I disputed these charges.I didnt know or wasnt wise enough to put this in writing at the time but I had numerous telephone conversations with bank personnel disputing the charges. She also informed me that the charges hadnt been removed but would be wrote off when I had paid off the £250 overdraft and my credit file would then read partally satisfied.Lost for the next step now any ideas ??????????????????:???:

you would need to contact the bank and get them to remove the default, also if you did not recieve a default notice then they shoild not have listed one against you

 

also write to the CRA and put a notice of dispute against the entry

I have contacted the bank by phone as I have said above but because they have said they have no record of dispute by mail (even though I disputed it by phone on many occasions ) when the default was issued they are refusing to remove the default.
