Good afternoon all,

 

I am with the support of the good people of this site, payplan and the local credit union slowly plotting a course out of my personal financial mess.

 

I had the good fortune on another thread to see that another payday loan company (EPDL) have been trading without a valid consumer credit liscence. Most of the other companies that I am in debt to amongst these providers can be found on the public search part of the OFT site for their liscences and they are all valid with (I think) the exception of the above. I have not proceeded past this search yet and hence the request for assistance from those more knowledgeable. The liscense number displayed on their site, Vgates or 4cashnow all bring back nothing on the search. Could this be another one without a valid liscense? :confused:

Well they have not answered correspondence advising change of bank details, request come to payment arrangement etc and proceeded to process payment against a cancelled/stopped card. Please take great care with giving these firms the details, preferably do not do business with any of them - you will end up in financial despair and even if strong and communicating with them it will eat you all your time and energy! If at all possible find another way around the unexpected expense!

They've done exactly the same thing with me - taken money from a cancelled card. I phoned my bank who are looking to prosecute them for fraud! My bank told me that some retailers can "force" a payment through, essentially by bypassing the bank's security arrangements. I asked if this was a prosecutable offence and they said they thought it was.

 

"V Gates Ltd" will attempt to take payments from cards that have been stopped, so look out for it, call your bank and get them to refund it immediately then take action against the company.

 

I'll update with the result.

This lot continue to ignore all correspondence and fail to return messages. I have sent them a CCA request earlier in the week but in the meantime they have started cashing cheques on that they led me to believe had been destroyed from a previous agreement with them! :mad:The bank were supposed to have issued a "stop" on the cheque book but still allowing these cheques through!!

 

Difficult to know what to do - they have now I believe accessed more than they were entitled to under the current "agreement" between us, ignored requests not to process payments on that account, ignored that I am in difficulty, ignored my payment proposal and generally behaved disgracefully!!

 

This is I would think probably fraudulent access to the account but I do not think involving the police would get us anywhere. Should I be reporting to all relevant agencies? Do I have grounds to pursue them for this in small claims (have taken more than they were owed before we start talking about methods!!). Given they are part of a much wider mess (see elsewhere on these threads) I am not sure I have the energy to pursue further ...... need some help and inspiration please, I am getting steadily more down with the whole thing!

Okay folks this gets better. Via a combination of debit card details on a card that was cancelled (and their authority to use it or process for any purpose revoked in writing) and presentation of cheques from a previous transaction with them where they had led me to believe the cheques were destroyed (following appropriate discharge of the liability to them) this firm has not only claimed their total "contractual rights" (to some £200 more than they loaned) but gone on in excess of £120 over that!!! :mad:

 

What next? I have given them a very short time to respond with appropriate remedy (excess amount and offer for distress and further costs caused) but do not expect they will. I think complaint to FSA and BCCA but after that? small claims? media??

 

Surely we are talking illegal activity - they can (and have) ignore my communication in relation to difficulties and repayment proposals but processing for the whole lot (when told not) and then some extra for good measure??! Should I add contact with the police into this?

 

I am with the support of folk here and a lot of determination making headway but I this is the worst yet...... any help or suggestions gratefully recieved please ........ :oops:
