A couple of months ago we stupidly took out a couple of payday loans as bank charges we taking most of our wages. We are now having difficulty paying them back, we have had a few problems with a suspended repossession order and council tax arrears, these are now sorted but we are still only scrapping through each month.

As anybody has any luck with getting these people to accept monthly repayments. We cannot afford to pay them all off in full, total about £900 and we obviously don't want anymore. We felt we where getting straight but we know feel we have to start a battle all over again.

Can anybody help

Has anybody any ideas as I know I will get a phone call from them today.

I'm going to e-mail them to communicate only by e-mail if this will do any good.

If the man ringing keeps with the same tone of his phone calls I will be putting in a harrassment complaint before too long

These types of loans are generally not good. They escalate problems and come with nasty terms and nasty interest rates.

 

Instinct says they might be challenging, but I suppose it depends on the actual companies and whether they are feeling reasonable *cough*.

Hi Kaz,

 

I have dealings with Pounds till payday. The bark is worse than the bite.

 

I ran into severe difficulty after having loans with them month after month. At the end it just got out of control.

I told the agent I couldnt afford to repay the total and they then offered me a settlement of about 30% less, this didnt help because the interest they charge is so high.

 

They have given my details to a collection agency called Clarity, another bunch of village idiots. I told them I will only pay £30 a month on the reduced offer Pounds till payday made. They have accepted this and I only pay £30 a month and they havnt bothered me since.

 

NOTHING has been recorded on my credit file and they are NOT allowed to contact your employer. Tell them you will only deal with any requests in writting to your e-mail, thats what I do with them.

Forgot to mention, cancel any details with the bank. They tried to debt my account for money even when I didnt approve it. I pay them by cash each month directly into the account. DO NOT give them bank details to debit the money from.

The person I speak to has my e-mail address and he's just e-mailed me to confirm the telephone conversation, the e-mail is from Claddagh Contact Centres in Dublin.

As anybody had any dealings with these - This is from the loan with Pounds Till PayDay.

I'm thinking about e-mailing Pounds Till Payday directly and see what I get as a response from them.

I would do a reply email telling them that you want all communication in writing only and that the doorstep collector will be wasting their time as you have absolutely no intention of speaking to them. Cut and paste the following:

 

Dear xxxx

 

Account Ref xxxx

 

Please be advised that I will only communicate with you in writing.

 

Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.

 

There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

I've sent them an email stating to only contact me via e-mail I also added that I will contact the OFT if they continue to phone me at work and that due to financial problems I cannot pay the debt in one payment but I wish to set up a payment plan to pay this off at a level I can manage.

 

Well talk about throwing the toys out of the pram.

He rang me at work as this was the only phone number he got to speak to me on. They have left messages at home ,but they way he spoke there was no way I was talking to him. They have my address, couldn't they write.

As a payday loan company they have to adhere to very stict guidelines and they cannot roll over or offer extensions to loans.

If I pay half this month they will hold the other half until January - surely this is rolled over?

He's also stated that I said the problem was with my bank, I infact "stated this several times as your excuse as to why funds haven't been received by us". I know I never told them it was the banks fault I said I would need to check with my bank, meaning to see what money I had left, although I didn't put it in them terms obviously. I have this on a taped line so he doesn't stand a chance of backing this statement up.

 

He's said unless I pay half of the debt - which I have no way of doing then he's no choice but to pass it to their 3rd party external recovery team, which as he stated may or may not call upon my home. I've not told him yet about the legality of home visits.

 

Would it be best to get this passed on, does anybody know who they external recovery team is.

With the attitude of this man I've no intention of speaking to him in person

Mine was passed onto a company called Clarity. They are also a bunch of village idiots but they accepted I wouldnt pay a lump sum and they would have to settle with what I offered.

 

My debt is £1090, was £1300 sumthing but I told them I wanted the reduced amount offered by Pounds Till payday. They agreed and have accepted my offer of £30 a month. And to date they have left me alone. I just make payment into thier account directly for that amount.

 

Just dont back down and let them know if they call your work place again you will note this and sent off the details to the FSA.

I`ve told him to pass the debt onto their collection people so hopefully I won`t need to deal him again. Think I might still issue a complaint though as his e-mails where quite aggressive.

Hi,

 

while I'm no expert on this sort of thing I noticed that the reason you took out these loans was due to bank charges. Have you thought about claiming these bank charges back at all??? What where the bank charges for?
