  1. Chilling it was an oral agreement I'm afraid. I'm not applying to get any order stayed. I applied to get the eviction set aside as Mortgage express gave me impression that it was against tenants & myself rather than just tenants. The judge was siding with me but then stayed for 2 weeks. As they haven't got possession would I need an injuction right now?
  2. The 2 week stay. I would like to know should I apply to get original suspended order set aside now as no arrears or wait until I go back to court? Can mortgage express force me to sell property now?
  3. Hi thanks for advice. I'm a bit confused what your telling me to check. The receivers applied for bailiffs to take possession from tenants but also persons unknown which would have been me. My tenants moved out & I moved in. I paid arrears but mortgage express still said they want me to redeem mortgage. I applied to get eviction set aside as I moved in & arrears now clear. The judge stayed it for 2 weeks for receivers to provide relevance in evicting me. They must provide skeleton argument 2 days prior to hearing. There are 2 claim numbers. 1 relating to claim against tenants & 1 relating to my suspended evictions in the past. The next hearing they will be brought together. The judge seemed to be on side in relation to saying the receivers technically had possession as tenants moved out & I have retaken possession.   4. Hi I know this is not the correct place to post but I am having difficulty starting a new thread. My problem is regarding mortgage express & lpa receivers. I have been in & out of arrears for some time. In December MEx appointed receivers instead of going through with a possession order. I was told once arrears clear i can get back full control of my property. Tenant moved out not to long after & I had no tenant for a few months. Any payment made to Mex since recovers instructed have came from me direct rather than through receivers. Receivers took my current tenant to court as trespassers because they have moved in after they were instructed. Possession was granted but the receivers solicitors stated that this would not affect me as it was against tenant for no contact but once tenant contacts them they can remain. After the court case I called Mex to clarify what the arrears situation was & to confirm if I pay all arrears will this get rid of receivers. I was told that this was the case. They would need to know details about my current finances but yes property would be passed back to me. Today I receive a call from Mex stating that regarding my last call the position is now that they will be trying to sell property & only way to stop this is to redeem mortgage. I really need help. I would like to know if I pay arrears what will be the situation? Can I move into property & pay mortgage myself? Any help much appreciated
  5. hi thanks for replying. insurance with direct line. just came off the phone to them and they have said i have to make payment to bring premiums up to date. no option to take out of settlement cheque. i will definitely be sending in S.A.R. i will make payment today as need this sorted no car is killing me. my fear is that me is paying some sort of admission of me failing to disclose relevant details.
  6. hi i have car insurance and have recently had my car stolen so had 2 make a claim. whilst processing my claim i was told that they done a check and noticed that i had already made a previous claim with different insurer and didnt notify them of this claim. i explained i had notified them but as i took out policy on internet maybe mistake, as my policy docs clearly state that my bonus is 0 so why would i think different as i had 3 years bonus previously. they told me part of policy was taken out over phone so they will listen to call and get back 2 me. chased them up after couple days they then said it would still take longer up to 2 weeks. got a call today saying they still haven't listened to call but there underwriters have told them regardless of call i should of notified them once my docs came as it should state that i have had no accidents. i told him i woul need to check my docs cause not at home when he called. he then said because my policy was based on me not having any previous claims that i should have paid nearly double what i did pay. also unless i do pay the extra i should have they are not going to look into my claim any further. have now checked policy docs and on the front it does state i have 0 years bonus but on the back it states i havent had any claims. basically i have some questions. 1. is this right for them to charge me more when as far as im concerned i did notify them about previous claim. 2. can they tell me unless i pay extra my claim cant proceed. 3. will they make me pay extra then void my claim for failure to disclose. 4. cant they just take extra from my settlement cheque. any help appreciated.
  7. handed in apllication and got hearing date for today. judge granted my suspended possesion request. bailiffs would have been evicting me on 10th april. thanks to wonderful help from Ell-enn i went to court prepared and got to keep my house.   8. hi there. trying to find out how i go about getting copy of call to insurance company. they say i never told them about previous claim, but on my policy document it clearly states i have 0 claims bonus whereas on previous insurance with old company i had 3 years no claims. they are in process of listening to call. i would rather hear it myself as not very trusting of insurance company during claim. any advice welcome.
  9. hi i am having my buy 2 let property repossessed as failed to stick to previous agreement to pay off arrears. currently being helped with n244 form. any other advice apreciated.
