  1. Thanks guys, I have just downloaded Vamp's Spreadsheet and filled it in and it came to within £5 of my own working out this morning. Wonderful Site and thanks for all your help. Expect a contribution from me as soon as this claim gets settled. Thanks again.
  2. I have calculated the Interest based only on 8% from the various dates which the Bank removed the credit from the account. Unfortunately this takes us over the £5000 threshold. Are you saying I should also be reclaiming the Interest the Bank Charged? Because I thought the 8% was supposed to cover that. If so, how does one establish what rates of interest the Banks have been charging over the years?

  4. She has at least two County Court Judgements against her, which I am sure would have been avoided if she had had her money available and not scooped up by the Bank.
  5. I posted this a few minutes ago and now I can't find it. I am pursuing a claim on behalf of a neighbour for £5000 taken in charges over the past 6 years. What is the general opinion regarding adding a claim for damages for the distress caused by the loss of her money? She has been threatened with eviction from her home for non-paymnent of Rent and I have also had to negotiate with Bailiffs on her behalf. Considering that the bank took £395 last September, £580 in October and £545 in November last year, and her Rent only amounts to about £350 per month I feel that her problems which have driven her almost to the brink of suicide would not have occurred if she had had access to all her earnings.

  9. You have the right on your side, and from what I read the Judges do not like the way that Banks rip off their Customers. You probably feel intimidated because they are "The Big Boys". Nobody minds paying a pound or two but the Banks see Charges as the Golden Goose. Be brave, be strong, stand your ground and I am sure you will get a positive result.

  11. This is what pees me off the most about the Bank Charges, that they take the most from those who can least afford it. My neighbour, a single mother with two daughters, (husband left her years ago) was being charged £500 a month when she came to me crying her heart out and under threat of eviction for Rent arrears. (The Rent is about £350 a month). So far I have managed to recover about £1500 for her and am still pursuing another £3000.
  12. If you have just ceased trading and not put the affairs into the hands of a Liquidator you are still entitled to receive and keep any Assets of your business (subject to Tax where applicable). The Charges applied by a Bank, if proved to be unjust, are Unrealised Assets and you have a right to recover them.
  13. Hi everyone, I found this Site, not for myself but for a neighbour who has struggled to raise her two daughters for the past 10 years without her husband wh had left her for another woman. She has struggled to survive, sometimes having up to 3 jobs to try to keep their heads above water. She has been threatened with eviction for Rent arrears, and had a letter from the Bailiffs regarding Council Tax, and she came to me crying her heart out. I had a look at her Bank Statements and was astonished to discover that between October and November Abbey had deducted £1,125.00 in charges for unauthorised borrowing, much of which was in Direct Debits or Cheques honoured although there was no money available. Further investigation showed that she since February 2001 she has been charged £4781.00 in tthis manner. What a vast difference that money could have made to her quality of life. Wiith her permission I telephoned the Bank and explained her position and had her overdraft raised to prevent further charges, and at the same time found this Website so, following your guidance, I corresponded with the Bank and am happy to say that they have so far refunded £1580.00. The letter informing this, while dated 4th Jan was not received until the 12th and the money was in her account on the 15th. There was no "option to reject the offer" in the letter, but they did state that they would keep the file open for 8 weeks. I would like to know how to word my next letter (the 14 day one) to acknowledge receipt of this sum, yet to show that we are still pursuing them for the rest. I assume that we still need to apply for the refund of the whole £4781.00 in case we get judgement for £3201 and they claim that they have already refunded half of that.
