  1. So far, But i decided from now on i will only write and only accept written communication from them. All the information about me, including the address, is all valid and they have all that!! I thought it was just a mistake at first, that's why it has all been by phone,
  2. It does show in the summary part but also on the main report, shows as Default rather than Up to date.
  3. Hi, Haven't been on the site for a while but i need some advice! I bought a car through The Car Finance Company about 18 months ago, over 36 months. I have never missed a payment, nor has any payment been made late, around September 2017, i was involved in a road traffic collision and the insurer said it was a total write off. It was a low speed impact so no injuries thankfully. I have spoken to the insurers and have retained the car to make the repairs before i re mot it. It is only bodywork, nothing mechanically wrong with the car. The insurers paid the Car Finance Company and i thought was that. Since the accident though i have been thinking about replacing the car with another, i thought with the way i have handled this agreement that would improve my chances of getting further finance. i checked my credit file and noticed, at first, 1 Default Notice, then a further Default Notice added the following month. I have contacted TCFC and raised a complaint so far i am getting passed from pillar to post and getting nowhere!! I have been informed by TCFC that as the car is a write off that the agreement was cancelled and the shortfall must be made and any payments would be subject to Default? Since the accident i have maintained the payments now i am doubtful whether TCFC are doing things legally. I have 2 payments left on the agreement and i am not sure whether to pay them or not. I have had no letters or any contact with them until i raised the complaint My questions are, Can they add a Default Notice on my Credit File without letting me know, even if the payments have been made to the correct time and date they fall due? What would be my chances of taking Legal Action against them being successful? Look forward to your advice. cuzznx
  4. Good Morning all, I have been scammed by myloan-now as well. I contacted Natwest to initiate the chargeback process, however Natwest told me that because i had been looking for loans there is nothing they can do. I tried to make them understand that i might have been looking for loans but i never authorised myloan-now, i hadn't even been on their website, to take any kind of payment. I have been stung by these kind of credit brokers in the past, so the minute i see " we will charge a fee for our service " i close the browser. What i am trying to do now is get some clear information about the Chargeback scheme and how it works, because Natwest refuse to do it. If anyone can give me some info regarding this kind of transaction and how the Chargeback scheme works in relation to this kind of thing, i would be extremely grateful. cuzznx

  6. Hi citizenB, I am not sure because the charges were taken every month regardless of making a cash withdrawal and even so a cash advance fee was taken anyway. The amount of the fees each month far outweigh any money i withdrew anyway. cuzznx
  7. Hi Everyone, I haven't been on the site recently but i have a question in relation to MBNA and reclaiming, etc I sent MBNA a SAR request, which arrived last week, but looking at the statements, there are a number of charges and interest payments that i don't understand, i hope somebody will tell me what these are and what exactly i can claim back. The payments that are taken are Special Cash Interest Posted Cash Advance Interest Posted Retail Interest These payments were taken every month and each month totalled around £60 There was one other payment that also got taken each month, Posted Credit Insurance fee, that appeared on the statements for about three months and then disappeared. Can i claim all these payments back or is it just the ppi fees and the other excessive fees associated. Cheers cuzznx
  8. Hi conniff, Just wondering if any further input has been made regarding my last email. It is worth noting that someone from Arnold Clark rang me on New Years Eve and left a message. I am now waiting to hear from them before i take any further action. Cheers. cuzznx
  9. Hi conniff, No worries, I didn't expect any immediate responses. Enjoy your tea!! I could have done the same but i haven't got the hire car!!lol Cheers. cuzznx
  10. Hi stu007, I paid in full at the time of booking on my debit card. Had they required a deposit, it should have been taken then, which i could have questioned later. cheers. cuzznx
  11. Hi Conniff, Yes, at the time of booking and since, about 2-3 times. I have already printed the pages from arnold clark website, just in case! http://arnoldclarkrental.com/faq http://arnoldclarkrental.com Cheers. cuzznx
  12. Hi all, I have a question that i hope someone can help me with. I booked and paid for a car from the above company, for one week over the Christmas period, to pick up on Christmas Eve. I booked and paid for this car via their website, well in advance of the holidays. Having been stung before by another company, i checked Arnold Clark website looking for the amount of deposit required. It clearly states on the FAQ page, that a deposit is not normally required, however check at time of booking. Now being completely paranoid these days, i checked by phoning the company and asked if a deposit was required, the answer i was given was a definite "NO" I still wasn't sure though, as it is strange that most other companies require a deposit, so i checked the website again and trawled every page, nothing. I phoned the company again a few days later to double, double check and was given the same reply "NO" On the day of hire, i phoned the branch from where i was due to pick the car up from and was put through to a central switchboard, who also couldn't get through to the branch but they would get them to phone me back, still waiting!!! While on the phone i asked again from customer services if a deposit was required, the answer again was"NO". I went to pick the car up and on entering the reception, i was met with a sign that from "30/10/12 a £200 deposit was required" I assumed that didn't mean if you had already prebooked. I presented all the documentation that they had requested and was then asked for a £200 deposit. When i explained that no mention of a deposit was made, either verbally or via the website, i was told that it states on the website FAQ page that a deposit is required. I pointed out that it doesn't say that at all and refused to pay a deposit, they refused then to hire the car to me and refunded my money. My question is, are they in breach of contract and do i have a right to sue them in the small claims court? I had taken what i deem necessary action to ensure the validity of the hire agreement. When i got home i phoned the customer service department to complain and was told that it was now company policy to take a deposit, although, no where on the site or elsewhere does it say about that. Needless to say, my refund will not go into my bank until after christmas, so i couldn't go elsewhere and get something arranged. Christmas has been ruined, i was unable to go over to my son's and spend the holiday with his family and my grand daughter's first Christmas, as was arranged. Someone please tell me that i have a good case or even some advice. Cheers. cuzznx
  13. Hi tigga 1961, Thanks for the info,my concerns are that i have explained the situation to them and that at the moment i am struggling to keep up the payments. I have asked them to extend the term, they refused, i asked them to change the payment date, so that it falls in line with when my benefits get paid, they refused unless i paid a month in advance (if i could afford that i wouldn't have been having the conversation with them in the first place). As for my son, he agreed to be my guarantor because i asked him, if he had known what it entailed, he would have refused. My fault? yes entirely. I have never had any trouble before with creditors, all have been sympathetic, but FLM!!! No chance!! What is so annoying is, i never even applied to FLM for a loan. It was sorted out by one of these so called brokers. But that is entirely beside the point, there must be some way of reasoning with them?
  14. Has anybody got any suggestions on how to deal with FLM, i have tried asking them to spread payments over a longer term, i have asked to change the payment date, all to no avail? I don't normal let these people bother me but the constant text messages and phone calls about my late payments and charging me £20 for a letter when the payment was only 3 days late. I am having some quite severe financial problems at the moment and am really struggling to cope. If it wasn't for the fact that my son is also my guarantor i would tell them to go *^ck themselves!!! I really don't know what i can do because they are being so awkward and obstructive. I know that i should never have taken the loan out in the first place cos i really couldn't afford it and really FLM should never have offered it to me, given the amount of financial commitment i already had and also my son couldn't really afford to act as a guarantor either, again due to the level of financial commitment he already had. What happened to the"Responsible Lender" policy. Is there anything i can do to get them off my back because they are really starting to stress me out??
