  1. I want to claim back charges applied to my credit card account going back 6 years. Does anyone know the address to write to request copy statements? Cheers
  2. I decided to accept their offer and wrote saying I require payment by cheque as the account they wanted to pay into is now closed. This was on 22 February but I have not received the cheque as yet. I have since learned after contacting the court that they intend to appear in court on March 6. It seems strange to make an offer and then defend the case in court. Not sure if their is some tactic here or if there is no communication between customer relations and their legal people, so it looks like I have to go to the court on Tuesday with their letter of offer which seems a bit pointless. Is this normal? Does anyone have any experience of this?

I have been out of the country for a month and just got back to find a letter from Sandy Watt at customer relations offering £1410 in full and final settlement of my claim without admission of liability etc. The actual amount claimed is £1298 charges plus £421 interest, total £1719. Their offer does seem reasonable but I am thinking to phone them to see if they will pay the full amount or at least increase the offer. The return date for the summons is 27th February and after phoning the court yesterday I know they have not submitted a defence yet. Should I hold on and see if they put a defence in, as if they don't I win by default, or should I contact them now to see if they will up their offer? Any advice appreciated
  4. Hi Steve Alternatively you could raise an action called Summary Cause which means you can claim from £750 up to £1500 instead of splitting into 2 small claims. The cost of this is the same - £39. You will find all the info you need here Summary Cause Guidance Notes You can complete the forms (1 & 1b) online then print off and hand into your nearest Sheriff Court. Hope this helps Cheers
  5. I decided to phone customer relations to hear what they had to say which of course was a waste of time. They are considering each case individually and due to the volume they can't give any timescales as to how long it will take to consider mine. I feel a bit of an idiot for allowing them to delay me but am going to hand the summons in next week. Am I correct in saying that with summary cause I have to wait for the papers to be sent back to me with the return date and then I have to get a sheriff officer to serve them on the bank? How long does it usually take the court to send the papers back and do they then have to be served on the bank within a certain time? Any help appreciated

I sent my LBA on 6th December and heard nothing until today when I received a letter from Sandy Watt in customer relations apologising for not responding sooner and asking that I bear with them as they are currently investigating and will respond as soon as possible. I had the court summons prepared before this letter which I was going to hand in to the court on Monday. Should I proceed with the summons, wait and give them some more time or phone customer relations and tell them unless they pay up I will proceed with the summons? Any advice is appreciated.
  7. I sent my LBA on the 5th December giving them another 14 days to pay the £1719.59 they owe me. I expect that they will refuse to pay again or offer a reduced settlement, so am preparing now for the court stage. As I live in Scotland I understand I have to make a claim called a Summary Cause through the Sheriff Court, but the maximum that can be claimed is £1500. Should I split the claim into 2 or just claim for £1500? Any advice would be appreciated.

I received a reply today from Tommy McLean at customer relations stating that they would not be refunding any charges as they believe them to be 'fair, reasonable and transparent', and that the OFT's statement of 5 April 2006 related to credit card accounts only and not current accounts. I am going to proceed with the LBA now but have a few questions that hopefully someone can help me with. Firstly should I send the LBA addressed to Tommy McLean at customer relations in Edinburgh or to the customer care care team in Telford where I sent the original claim to? Secondly should I amend the date of service on the charges speadsheet to the date I am sending the LBA or leave it the same as on the first request for repayment I sent? Lastly I have added interest on at 8% which after reading several other posts think this was maybe the wrong thing to do as it seems that this is only added on at the court stage. Should I remove the interest from the spreadsheet I am sending with the LBA or leave it on as I am not sure how to calculate the actual interest incurred as a direct result of the charges. I thought this was interest I was charging them for having money of mine for the last 5 years. The spreadsheet I am using is the excel simple, Scotland one. Any help or advice would be greatly appreciated. Thanks
  9. I sent my claim to RBOS on 15 November requesting repayment of £1719.59 taken from my now closed account in charges over the past 5 years. I received a reply from their customer care department dated 20 November saying that they had passed my claim to their customer relations department as it related to the bank's charging policy, and they would respond to me directly within 10 working days. The 14 days I gave them to respond has now gone so should I now proceed with the LBA or wait another few days to see if customer relations contact me? Thanks
  10. I am just about to send my claim to RBOS but am not sure what I should put as the date of service on the spreadsheet. I am using the excel simple Scotland one. Should I use the date the last charge was incurred (19/02/03), the date the account was closed (27/02/06) or the date I am sending the claim? Thanks
